2 THE NATIONAL INSTITUTES OF TECHNOLOGY, SCIENCE EDUCATION AND RESEARCH (SECOND AMENDMENT) BILL, 2016 The National Institutes of Technology, Science Education And Research (Second Amendment) Bill, 2016 seeks to include the Indian Institute of Science Education and Research (IISER) Tirupati and IISER, Berhampur in the Second Schedule of National Institutes of Technology, Science Education and Research (NITSER) Act, 2007 so as to increase the presence of IISERs in various States to cater to the need for quality education in Science and Research. The Minister of Human Resource Development, introduced the Bill in Lok Sabha on 9 December Background The National Institutes of Technology, Science Education and Research Act, 2007 (the Act) provides for declaration of certain institutions of technology, science education and research as institutions of national importance and to provide for instructions and research in branches of engineering, technology, management, education, sciences and arts and for the advancement of learning and dissemination of knowledge in such branches and for certain other matters connected with such institutions. Initially, twenty societies of Institutes of Technology spread across the country were incorporated in the Act as the National Institutes of Technology and the same were included in the first Schedule to the Act (Sl. No. 1 to 20 at Annexure I) 1. The Act was first amended in the year 2012 incorporating ten more National Institutes of Technology in the First Schedule (Sl. No. 21 to 30 at Annexure I) and inserted a Second Schedule incorporating therein five new Indian Institutes of Science Education and Research (Annexure II) 2. 1 First Schedule of NITSER Act, 2007 is given at Annexure-I. 2 Second Schedule of NITSER Act, 2007 is given at Annexure-II.

3 2 The Act was further amended in 2014 incorporating the Indian Institute of Engineering Science and Technology, Shibpur in the Third Schedule to the Act (Annexure III) 3. Consequent upon the bifurcation of the State of Andhra Pradesh and as provided in section 93 of the Andhra Pradesh reorganisation Act, 2014 read with Thirteenth Schedule thereof, the Central Government was required to establish a National Institute of Technology and an Indian Institute of Science Education and Research in Andhra Pradesh. The National Institute of Technology, Andhra Pradesh was established by enactment of the National Institutes of Technology, Science Education and Research (Amendment) Act, 2016 and was included in the First Schedule (Sl. No. 31 at Annexure I). Salient Features The Bill amends the National Institutes of Technology, Science Education and Research Act, 2007 (NITSER Act). The NITSER Act declares certain institutions of technology, science education and research as Institutes of National Importance and provides for research, training and dissemination of knowledge in these institutions. The 2007 Act was amended in 2012 to include a number of new institutes within its ambit. A Second Schedule was added to include new Indian Institutes of Science Education and Research under the 2007 Act. The present Bill seeks to incorporate two institutes to the Second Schedule of the NITSER Act namely, (i) Indian Institute of Science Education and Research, Tirupati (Andhra Pradesh); and (ii) Indian Institute of Science Education and Research, Berhampur (Odisha). 3 Third Schedule of NITSER Act, 2007 is given at Annexure-III.
