1 Policy BOARD POWERS AND DUTIES Code BBA Issued 8/05 Purpose: To establish the basic legal structure in which the board operates. The board takes a broad view of its required functions. It sees them as the following. Legislative/Policymaking The legislative authority includes policymaking action and the review of rules and regulations established to put policies into operation. The board is responsible for the adoption of policy. The policies will be put in written form and continually re-evaluated in terms of the changing needs and functions of public education. Executive The superintendent performs administrative duties for the board by the powers delegated to him/her. The board must hold the superintendent responsible for the proper and efficient administration of schools. Quasi-judicial The board serves in a quasi-judicial function when it acts on appeals of parents/legal guardians, pupils or employees on decisions made by the superintendent or his/her designee. Appraisal and approval The board is responsible for evaluating the effectiveness of its policies and how well they have been put into action. The superintendent recommends specific action, and it is the function of the board to appraise the value and importance of each recommendation and to act on each proposal. Educational planning The board is responsible for requiring and acquiring reliable information from responsible sources which will enable it and the staff to work toward the continuing improvement of the education program. Interpretation The board is responsible for providing adequate and direct means for keeping the local citizenry informed about the schools and for keeping itself and the staff informed about the wishes of the public. All planning, both that which is and is not related to the budget, needs to be interpreted to the public if citizens are to support the school program. Operational action The board is responsible for the machinery and process of carrying on board business, such as adopting a procedural form for meetings, election of board officers, and providing the enforcement of state laws and directives of the state department of education.
2 PAGE 2 - BBA - BOARD POWERS AND DUTIES Provision of financial resources The board has the major responsibility for the adoption of a budget which will provide the wherewithal in terms of buildings, staff, materials and equipment to enable the school system to carry out its policies. Reviewing action The board has final authority within the law for the operation of schools. No section of these policies and procedures may be construed to limit the statutory powers of the board to exercise its own judgment on the basis of the recommendation of the superintendent. Visits to schools Board members should make official visits to the school only under board authorization and with the full knowledge of staff including the superintendent, principals and other supervisors. Board members may make informal visits to schools or classrooms after making arrangements for visitations through the principals of the various schools. Such visits will be regarded as informal expressions of interest in school affairs and not as "inspections" or visits for supervisory or administrative purposes. State law The law of the state requires district boards to discharge certain duties and confers upon them many legislative, judicial and executive powers including the following (statutory references to sections of the S. C. Code, 1976, as amended). Legislative (rule-making powers) - General: Boards...may prescribe such rules and regulations not inconsistent with the law as they deem necessary or advisable. ( ) - Specific: The board shall promulgate rules prescribing the scholastic standards of achievement and standards of conduct and behavior that must be met by all pupils as a condition to the right of such pupils to attend the public schools. ( [3]) Judicial powers The board may conduct hearings or delegate this power to one or more members who will report to the board. ( ) Executive powers In the executive area, the board's powers include the following. - controlling the educational interests of the district, with the right to operate or not operate any school or schools ( [7]) - suspending or dismissing pupils when the best interest of the schools makes it necessary ( [3]) - transferring and assigning pupils ( [9]) - prescribing conditions of attendance for children not meeting eligibility requirements, subject to certain conditions ( [10]) - providing school-age child care programs or facilities ( [11]) - controlling school property of the district ( [5]) - establishing the annual school calendar ( [12]) - acquiring land by condemnation ( , ) - providing suitable school houses ( [1])
3 PAGE 3 - BBA - BOARD POWERS AND DUTIES - selling or leasing school property, with a report to county board or county council ( ) - waiving state restrictions on attendance for any person who is less than five or more than 21 years of age to attend any of the free public schools ( [3]) - holding in trust gifts made to district on giving approved bond ( ) - employing and discharging teachers ( [2]) - establishing and controlling schools for eleemosynary institutions ( ) - insuring motor vehicles ( ) - conveying school property no longer needed for school purposes ( ) - requiring teaching of certain enumerated subjects ( ) - approving claims against school funds ( ) - charging matriculation and incidental fees ( [8]) - making annual reports to state superintendent ( ) - visiting schools within the district...at least once in every school term and taking care that they are conducted according to law and with the utmost efficiency ( [6]) - calling meetings of the qualified electors of the district for consultation in regard to the school interests thereof, at which meetings the chairperson or other member of the board shall preside, if present ( [4]) - fixing the time of operation of schools ( ) - providing for an annual school census ( ) - providing protective eye devices to persons in certain labs and classrooms ( ) - admitting only those beginning students who produce a birth certificate and a certificate of immunization; immunization standards are those required by the State Department of Health and Environmental Control ( ) - requiring competitive bids for buildings or additions constructed from state funds, with some exceptions (S. C. Consolidated Procurement Code, Sections , , et seq. and ) - providing an accelerated program for qualified high school students ( ) - developing a comprehensive five-year plan with updates ( ) In addition to the powers conferred above, the board of education is empowered by law to do the following. Adopt and alter a corporate seal. Exercise all powers now or hereafter vested by general law in the boards of trustees of the several school districts of the state. Employ the county superintendent of education. Upon recommendation of the county superintendent of education, employ such personnel as is necessary for the efficient operation of all of the schools in the district. Distribute all state and federal funds received by the school district. Adopt administrative policies and procedures. Purchase land, plan and construct new buildings, and keep existing buildings in good repair and usable condition. Borrow in anticipation of the collection of taxes, state aid or federal aid. The borrowing will be in the form of notes, maturing not later than one year from the date of issue, bearing such rate, or rates, of interest as said board will determine. Such notes will be payable, both principal and interest, from the funds in anticipation of the receipt of which they are issued, and to the payment of the principal of and interest on such notes such funds will be pledged.
4 PAGE 4 - BBA - BOARD POWERS AND DUTIES Borrow in anticipation of allotments from the state Educational Finance Commission, for construction of school buildings, and pledge as security for the loan the proceeds of said allotment, or allotments, of the state Educational Finance Commission. The borrowing will be in the form of notes maturing and bearing such rate, or rates, of interest as the board of education will determine. The board will have the right to pledge such other funds or expected income for their payment of principal of or interest on said notes, as to it may appear to the best interest of the School District of Marlboro County. Exercise eminent domain. The procedure for exercising eminent domain may be any of those prescribed by law for public bodies or political divisions of the state. Determine and evaluate the educational program in the schools. Establish and maintain a central purchasing system for the purchase of all contractual services, equipment and supplies. All equipment and supplies will be purchased by the board of education, or pursuant to rules promulgated by the board. Establish and operate a comprehensive student transportation system throughout the school district. The board will provide an efficient, businesslike, safe and adequate transportation system for the school children of the School District of Marlboro County, and operate it under such rules and regulations as it deems necessary to effect this function. Cause regular annual audits and, when necessary, special audits of all school funds in the School District of Marlboro County, including the funds of the administrative areas. One copy of each such audit will be kept in the office of the board of education and another copy will be filed in the office of the Clerk of Court for Marlboro County, to be open to the public. Carry out a continuous school census. Keep an accurate record of board proceedings. Control the expenditure of all state and federal aid to the public schools within the said school district. Arrange with adjoining counties or with North Carolina for interchange of students or educational services. Adopt a system of budgetary controls, and annually adopt, with power to revise when necessary, a budget sufficient to meet the educational needs of the school district. Prescribe regulations to govern teachers salaries in all the schools of the district and, through the means of such regulations, fix the salaries of all the teachers of all the schools of the district. Conduct surveys and, upon the results being obtained, reorganize administrative areas, attendance areas, the curricula, the supervisory program, auxiliary services and any other part of the educational program of the schools of the district. Regulate admission of students to the public schools of Marlboro County and designate the schools the various students, when and if admitted, will attend, under such regulations as it will prescribe; all acts or regulations of the board of education with reference hereto, heretofore done or adopted, are hereby ratified, confirmed and approved. Draw warrants upon school funds in the hands of the treasurer for the payment of insurance premiums for teachers retirement, for workers compensation premiums, for the payment of withholding taxes from salaries, and for all other purposes authorized by law.
5 PAGE 5 - BBA - BOARD POWERS AND DUTIES Equalize educational opportunity among the children of Marlboro County. Control and supervise the expenditures of all monies for capital outlay. Establish high schools and other schools in the district as may appear necessary and appropriate. Establish policies within the schools of each administrative area for the placement of students. Set up, in addition to the schools provided for two items above in this section, centers of instruction for vocational training, adult education and other courses which cannot be offered in the individual schools of the county.
