1 F.No / Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi /06/2010 O R D E R WHEREAS the appeal of Ansh College of Education (Aryan Foundation Trust), Gwalior, Madhya Pradesh dated 08/04/2010 is against the Order No. No.WRC/APW01851/223370/130th/2010/65988 dated 19/03/2010 of the Western Regional Committee, withdrawing recognition for conducting B.Ed course on the ground The institution neither submitted the document mentioned in the show cause notice nor a plausible explanation in respect of grounds (i) (iii) (iv) & (v) of the show cause notice. AND WHEREAS the Correspondent, Ansh College of Education (Aryan Foundation Trust) (hereinafter referred to as the appellant), preferred an appeal dated 12/04/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Amit Jain, Secretary, Ansh College of Education (Aryan Foundation Trust), Gwalior, Madhya Pradesh presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that (i). he had no option but to inform the visiting team that visited the institution on 19/11/2009, that it was unable to get the inspection conducted as the team insisted on inspecting the premises at 60, Ram Bagh Colony, Shinde ki Chhawani, Lashkar Gwalior and not at the correct address of the college and also wanted to inspect 3 courses on the same day. (ii). no inspection was conducted by the visiting team; (iii). the institute was never run at Ram Bagh Colony, it was earlier at Mama ka Bazar and later on shifted to Kedarpura site in trust s own building; (iv). permission for shifting was sought alongwith a fee of Rs. 40,000/- which was followed by an inspection on 11/02/2009 and this confirms consent of WRC to run the institution in newly constructed building; (v). the observation that the institution was conducting D.Ed., B.P.Ed. & B.Ed. courses from same premises is vague and the institution fulfills the norms of infrastructure for combined running of the courses; (vi). against the requirement of 4500 sqm. of land and 3000 sqm. of built up area for 3 courses, the institution has sqm. of land and sqm. of built up area; and (vii). for grant of permission by the Madhya Pradesh Govt. for use of institutional land for education purposes and for permission of the competent local authority for the building and its occupation, there are documents for verification. AND WHEREAS the Council noted that the institution applied for grant of recognition of the institution in rented premises at Kadam Sahab ki Kothi; inspection under section 14 was conducted and recognition was granted to the institution at Kadam Sahab ki Kothi; NCTE Hqrs in compliance with the directions of Hon ble High Court of MP at Jabalpur; detailed the inspection team to cause inspection of the institution on under section 13, at Kadam Sahab ki Kothi, however, the team
2 visited the new premises at Aryan/ Km-1 Stone, Near Nai Dunia Press and submitted its report for the B.Ed & D. Ed courses; this report was accepted by the NCTE and submitted its report stating that the institution is allowed to continue to have recognition the NCTE s recognition; later, the WRC vide its letter dt detailed the institution for an inspection under section 17 at 60, Ram Bagh Collony, Shinde; subsequent to this, one of the visiting team members. Prof. V.R. Savarkar wrote a letter to the institution on about the inspection of the institution situated at 60, Rambag Colony and in the report dt the team mentioned that the college was not located at the address given by WRC, but was functioning from Aryan, 10 Km stone near Nai Dunia Press, Piparoli Road, Kedarpur, Gwalior. and the institution applied to WRC for change of address from the premises Kadam Sahab ki Kothi to Nai Dunia Press, alongwith a fee of Rs. 40,000/- on From this information it was clear that inspection u/s 17 was in fact proposed at an address where the institution has not been functioning, this address is actually society s address. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal and remanding the case to the WRC for causing composite inspection of the new premises for all the NCTE s recognized teacher training programme of the institution and for further decision thereafter.. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal, set aside the order of the WRC dt and remand the case to the WRC for causing composite inspection of the new premises for all the NCTE s recognized teacher training programmes of the institution and for further decision thereafter. Accordingly, the case is remanded to WRC. NOW THEREFORE, the Council hereby remands back the case of Ansh College of Education (Aryan Foundation Trust), Gwalior, Madhya Pradesh to the WRC, NCTE, for necessary action as indicated above. 3 F.No /2010-Appeal NATIONAL COUNCIL FOR TEACHER EDUCATION Hans Bhawan, Wing II, 1, Bahadurshah Zafar Marg, New Delhi /06/2010 O R D E R WHEREAS the appeal of Dev Bhoomi Institute of Applied Science, Dehradun, Uttaranchal dated 17/04/2010 is against the Order No. F.NRC/NCTE/F-7/NRCAPP- 312/157th meeting/2010/ dated of the Northern Regional Committee, closing the file for grant of recognition for conducting D.E.C.Ed course on the ground The application submitted online is for D.E.C.Ed. course but considered for B.Ed. which is not permitted. AND WHEREAS the Correspondent, Dev Bhoomi Institute of Applied Science (hereinafter referred to as the appellant), preferred an appeal dated 23/04/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Pankaj Goel, Executive Membe and Shri. Rakesh, PA to Chairman, Dev Bhoomi Institute of Applied Science, Dehradun, Uttaranchal presented the case of the appellant institution on In the appeal and during personal presentation it was submitted that in the online application for B.Ed course due to typographical error D.E.C.Ed course was typed and when hard copies of the online application were submitted it was mentioned that the institution was applying for B.Ed course. It has also been mentioned that in the undertaking and affidavit submitted it was clarified that they were applying for B.Ed course and not D.E.C.Ed course. AND WHEREAS the Council noted that the NRC communicated a number of deficiencies in their letter dated 20/1/2010. One of the deficiencies read as application has been submitted online for D.E.C.Ed course whereas it has been overwritten as B.Ed In reply to this letter, the appellant requested NRC to process the application for B.Ed. course and forwarded all the supporting documents in favour of B.Ed. course. The appellant infact after downloading the filled in online application form rectified the mistake committed by him and attached with the hard copy of the application an affidavit dated mentioning the course B.Ed. In view of the above the Council came to the conclusion that there was adequate justification in accepting the appeal and remanding the case to the NRC for further processing on merit. AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal, set aside the order of the NRC dt and remand the case to the NRC for further processing on merit. Accordingly, the case is remanded to the NRC.
4 NOW THEREFORE, the Council hereby remands back the case of Dev Bhoomi Institute of Applied Science, Dehradun, Uttaranchal to the NRC, NCTE, for necessary action as indicated above. Angoori Devi Educational & Cultural Society (Regd.)}, Gautam Budh Nagar, Uttar Pradesh dated 13/04/2010 is against the Order No. F.NRC/NCTE/F-3/UP-1064/157th Meeting/2010/ dated 13/04/2010 of the Northern Regional Committee, refusing recognition for conducting B.Ed course (additional intake) on the grounds 1) The deficiencies communicated to the institute through letter F.NO.NRC/NCTE/UP-1064/155th Meeting/2009/15721 dated 29/01/2010 still exist as the reply has not been submitted by the management. 2) The land is not in the name of Institution. 3) Titles of books are not as per NCTE norms for B.Ed. 4) All labs are ill equipped. 5) The same building is being used for running Middle & Sr. Secondary Schools which is against the NCTE norms for B.Ed. 6) Only ten computers are available both for B.Ed. and M.Ed. courses. AND WHEREAS the Correspondent, Aster College of Education {Smt. Angoori Devi Educational & Cultural Society (Regd.)} (hereinafter referred to as the appellant), preferred an appeal dated 13/04/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. H.S. Sharma, Chairman and Shri. V.K. Sharma, Secretary, Aster College of Education {Smt. Angoori Devi Educational & Cultural Society (Regd.)}, Gautam Budh Nagar, Uttar Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the institution had replied to the show cause notice well before the appointed time i.e on ; the land was leased in favour of Smt. Angoori Devi Educational and Cultural Society by the Greater Noida Industrial Development Authority and the lease deed as well as supplementary lease deed were signed between Greater Noida and the society; the library of the institution was having 6128 books of B.Ed. consisting of 1106 titles and 2047 M.Ed. books which are as per NCTE norms; all labs are well-equipped in conformity with standard laid down with NCTE; the VT report did not point out any deficiency that middle and senior secondary schools were also being run in the same building where B.Ed. was run and the institution was having a total of 14 computers and in addition server computer was also located in the room of Principal. AND WHEREAS the Council noted that the Aster College of Education, J-I Sector 9, Greater Noida was granted recognition for B.Ed. course with an intake of 200 students vide NRC s order No. F.NRC/NCTE/F.3/UP-1064/2003 dated Subsequently, the NCTE (Headquarters), vide its letter No /2004/NCTE (N&S) dated , asked all the Regional Committees to obtain the staff list of teaching staff appointed through a due selection process, in respect of all the
6 teacher training institutions recognized by the Regional Committees from to and take further action in this regard. Accordingly, the NRC, vide its letter dated , called for details regarding staff statement showing their qualification, experience etc from the Aster College of Education within 15 days. As no reply was received from the institution, the NRC issued a show cause notice dated asking the institution why its recognition should not be withdrawn on account of non-compliance with reference to NRC s letter dated Subsequently, the NCTE (Headquarters) got an inspection of the institution conducted under Section 13 of the NCTE Act, 1993 on with a view to ascertain whether the institution was functioning in accordance with the provisions of the Act. The report of the visiting team of experts on inspection of the institution dated pointed out a number of deficiencies including that the institution was not having a Principal and that no faculty approved by the affiliating CCS University was appointed. The NCTE Headquarters, communicated the deficiency to the NRC asking the NRC to take appropriate action under Section 17 of the NCTE Act after following the due procedure, as the deficiencies were serious in nature and violated NCTE norms. After issuing a show cause notice dated and considering the reply thereto dated of the institution, the NRC in its 141st meeting held on 22nd to 24th May, 2009 decided to withdraw the recognition and accordingly, the NRC withdrew the recognition of the institution for B.Ed. course with an intake of 200 students vide its order No.F.NRC/F-3/UP-1064/2009 dated on the ground that from the reply submitted by the institution, it was clear that the deficiencies pointed out on the basis of inspection conducted under Section 13 existed and that the reply submitted by the institution was not found satisfactory. The institution filed an appeal dated against the said decision of NRC taken in its 141st meeting dated 22nd to 24th May, 2009, to the Council. The Council, vide its order N /2009-Appeal dated , remanded the case back to the NRC for causing a composite inspection of the institution to verify the available infrastructure and instructional facilities for all the teacher training programmes in B.Ed (2 units) and M.Ed. Accordingly, the NRC got an inspection of the institution conducted on by a visiting team of experts. The VT Report dated , inter-alia, pointed out that only 10 computers were in working condition with licensed software, books in the library was not classified properly, only 700 titles were available, though principal plus 14 lecturer were shown on record, only eight lecturers were available at the time of inspection, items in the science lab were less in number, apparatus in psychology lab was less in number, B.Ed. students were being taken to their school science lab for practical purposes. The NRC, issued a show cause notice dated on the grounds that land was not in the name of the institution, only ten computers were available for both B.Ed. and M.Ed. courses, titles of books were not as per NCTE norms for B.Ed., all labs were ill equipped and the same building was used for running middle and Senior Secondary school which was against the NCTE norms for B.Ed. After considering the reply dated (received in NRC offer an ), the NRC, vide its order dated , refused recognition for B.Ed. course, against which the appeal under consideration was filed by the institution. the Council also noted that the order dated issued by the NRC refusing recognition to the institution for B.Ed. course was not in order as (i) the institution was already recognised and, therefore, refusing recognition to an institution already recognized did not arise, (ii) the ground that deficiencies communicated to the institute through letter F.No. NRC/NCTE UP/- 1064/ 155th meeting /2009 dated still existed as reply was not submitted
7 by institution, was not correct. The institution submitted its reply dated (received in NRC offices an ) which was available on the file and the same was also referred to by the NRC in its said order dated In view of above, the Council came to the conclusion that there was some justification in accepting the appeal and remanding the case to the NRC for issuing a revised speaking order by restoring recognition for basic unit of B.Ed. course only, but the recognition for the additional unit of B.Ed. course shall be withdrawn AND WHEREAS after perusal of documents, memorandum of appeal, VT Report, affidavit and after considering oral arguments advanced during hearing, the Council reached the conclusion that there was enough ground to accept the appeal, set aside the order of the NRC dt and remand the case to the NRC for issuing a revised speaking order by restoring recognition for basic unit of B.Ed. course only, but the recognition for the additional unit of B.Ed. course shall be withdrawn. AND WHEREAS the Correspondent, Rani Laxmi Bai Memorial College (hereinafter referred to as the appellant), preferred an appeal dated 22/04/2010 to the National Council for Teacher Education, New Delhi (hereinafter referred to as the Council) under Section 18 of the NCTE Act, 1993 against the said Order. AND WHEREAS Shri. Girish Verma, President, Rani Laxmi Bai Memorial College, Indore, Madhya Pradesh presented the case of the appellant institution on In the appeal and during personal presentation, it was submitted that the appellant institution had submitted the FDRs of Rs.5 lakh and Rs.3 lakh within 10 days from the issue of deficiency letter. AND WHEREAS the Council noted that the application of the institution was submitted on and the institution was required to submit hard copy of the application alongwith the requisite documents including FDRs within 7 days to the WRC as per the NCTE Regulations, the Council also noted that the FDRs were submitted by the institution on but the same were dated and thus they were purchased by the institution after the date of submission of the application online i.e and also after the cut off date for submission of the application i.e In view of the above the Council came to the conclusion that there was no justification in accepting the appeal and that it should be rejected. AND WHEREAS after perusal of documents, memorandum of appeal, affidavit, VT Report and after hearing oral arguments advanced during hearing, the Council reached the conclusion that there was no ground to accept the appeal and that it should be rejected.
