Minutes of the last meeting of the Executive Committee - Action taken thereon. The Executive Committee noted the action taken on the various items included in the Minutes of the meeting held on with the following modifications/additions:- Item No. 41 Action taken report of the Executive Committee meeting held on Recognition of medical qualification u/s 13(4) of the I.M.C. Act,1956 granted in Federal Republic of Germany. Action taken in the matter may be read corrected as under:- The matter has been considered by the President in consultation with the Chairman of Registration & Equivalence Committee of the Council as authorised by the Committee at its meeting held on The decision is as under:- 1. "We do not agree to relax the recognition of the already approved qualification of M.D.(Germany) granted by various universities." 2. It has also been decided that the qualifications "Arztliche Prufung" (Medical Doctor examination) and "Staatsexamen" cannot be included in the Schedule as the recognised medical qualifications since these appear to be qualifications other than "MD" qualification granted by Universities in Germany as the same is granted to those possessing "Arztliche Prufung" or "Staatsexamen" and submitting a thesis

2 subsequent to that. 3. It has also been decided, upon information received from the Cultural Counsellor, Embassy of Federal Republic of Germany, New Delhi, to recommend to the General Body of the Council for deletion of "Appobation Als Arzt (Karl Marx University, Leipzig) Eastern Germany" from the Schedule since this has been informed to be only a "Licence" to practise medicine in Germany and not a medical qualification. 4. It has also been decided not to include any opther medical qualification granted by Universities in Germany other than those already included in the Schedule upto date. 5. Indian nationals requesting registration on the basis of qualifications not included in the Schedule shall not be eligible for registration u/s 13(3) of the I.M.C. Act,1956 to practise medicine in India. Item No. 48: Action taken report of the Executive Committee meeting held on Non-appointment of Executive Committee members as Inspectors. Action taken in the matter may be read "Noted". corrected as 3. Establishment of New Medical College at Jammu by Krishna Hira Nand Memorial Society, Jammu u/s 10A of the Indian Medical Council Act, Read : The Council Inspectors report (7th & 8th Oct., 1998) for establishment of New Medical College at Jammu by Krishna Hira Nand Memorial Society, Jammu request of which was received u/s 10A of the I.M.C. Act, The Executive Committee considered Council Inspectors report (7th & 8th Oct.,1998) and decided to recommend to the Central Govt.not to issue Letter of Intent for establishment of New Medical College at Jammu by Krishna Hira Nand Memorial Society, Jammu u/s 10A of the I.M.C. Act,1956 in view of the shortage of staff, inadequate clinical material (bed occupancy) and other infrastructural facilities. 4. Shri Vasantrao Naik Govt. Medical College, Yavatmal - Increase of MBBS seats from 50 to 100 u/s 10A of the I.M.C. Act, Read : The compliance verification report alongwith the compliance received through the Central Govt. in pursuance of the letter of Intent issued by them for granting permission for increase of MBBS seats from 50 to 100 at Vasantrao Naik Govt. Medical College, Yavatmal u/s 10A of the I.M.C. Act, The Executive Committee considered the compliance verification report (Sept.,98) and decided to recommend to the Central Govt. to issue Letter of Permission for increase of MBBS seats from 50 to 100 at Vasantrao Naik Govt. Medical College, Yavatmal u/s 10A of the Indian Medical Council Act,1956 for a period of one year.

3 5. Govt. Medical College, Aurangabad - Renewal of permission for increase of MBBS seats from 100 to 150. Read : The compliance verification report (30th Sept.,1998) alongwith the compliance report and previous inspection report (May, 98) for renewal of permission for increase of MBBS seats from 100 to 150 at Govt. Medical College, Aurangabad. The Executive Committee considered the compliance verification report (30th Sept.,98) for renewal of permission for increase of MBBS seats from 100 to 150 at Govt. Medical College, Aurangabad. In view of the over all deficiencies pointed out in the inspection report, decided to recommend to the Central Govt. not to renew the permission for the said increase. The Committee further noted that inspite of Govt. of India's letter dated regretting renewal of permission of 2nd batch of students during against the increased intake i.e. 150 students, institution has admitted 146 students. The Committee viewed it very seriously and decided to initiate action u/s 10B of the I.M.C. Act,1956 against the excess number of admissions made by the college and also decided to request Central Govt. to take up this matter seriously with the State Govt. 6. Jhelum Valley College of Medical Sciences, Srinagar - Recognition of the college for the award of MBBS degree granted by Kashmir University. Read : The Council Inspector's report (5th & 6th Oct., 1998) for recognition of Jhelum Valley College of Medical Sciences, Srinagar for the award of MBBS degree granted by Kashmir University. The Executive Committee considered Council Inspectors report (5th, 6th Oct.,1998) and Govt. of J & K order dated received from the Additional Secretary to Govt. of J & K, which states that all assets, mobile, immovable, including beds and biomedical equipment, liabilities both financial as well as that of all categories of staff including students of Jehlum Valley College of Medical Sciences shall be taken over by Sher-i-Kashmir Institute of Medical Sciences, Soura, Srinagar. It further states that Sher-i-Kashmir Institute of Medical Sciences, Srinagar will provide all requisite logistic facilities, including that of faculty, other medical and para medical staff required for undergraduate teaching of medical graduates. In view of above, the Committee decided to permit the authorities to admit 80(eighty) students for one academic session i.e and rectify the deficiencies as pointed out in the inspection report and take measures to improve the clinical material & bed occupancy for consideration of the matter of recognition of the college. 7. MBBS (The Tamilnadu Dr. M.G.R. Medical University, Chennai) - Continuance of recognition of MBBS degree in respect of students being trained at Tirunelveli Medical College, Tirunelveli. Read : The compliance report received from the college authorities on the defects and deficiencies pointed out in the periodical inspection report (April, 94) for continuance of recognition of MBBS degree granted by the Tamilnadu Dr. M.G.R. Medical University, Chennai.

4 The Executive Committee noted the compliance received from the authorities on the inspection report carried out in April,94 and decided to carry out a fresh inspection to evaluate the teaching and training facilities available at the institution for consideration of continuance of recognition of MBBS degree granted by the Tamil Nadu Dr. M.G.R.Medical University in respect of students being trained at Tirunelveli Medical College, Tirunelveli. 8. MBBS (Dibrugarh University) - Continuance of recognition in respect of students being trained at Assam Medical College, Dibrugarh. Read : The compliance report received from the Registrar, Dibrugarh University on the defects and deficienciess pointed out in the periodical inspection report (April, 1997) of Assam Medical College, Dibrugarh for continuance of recognition of MBBS degree granted by Dibrugarh University. The Executive Committee noted that the Committee at its meeting held on had decided that a show cause notice be issued to the concerned authorities as to why steps should not be initiated to recommend to the Central Govt. to derecognise the institution for the award of MBBS degree for admitting more students beyond the sanctioned strength as seen from the inspection report carried out in April,97 for continuance of recognition and many other deficiencies in over all infrastructural facilities. The Committee also noted that one month's time was granted to the institution to respond to the show cause notice and that a letter has now been received from the Secretary to Govt. of Assam, Health & F.W. department giving assurance to rectify the deficiencies and further that the Academic Registrar, Dibrugarh University has forwarded a compliance report submitted by the Principal, however, certain deficiencies have still to be complied with. In view of the above facts, the Committee decided to give three months time to the institution to send a proper compliance touching on all the deficincies pointed out in the inspection report for further consideration in the matter. A copy of an inspection report be sent to the Secretary and Director of Medical Education to the Govt. of Assam, Health & F.W. Department for necessary action while communicating the above decision. 9. MBBS (Ravishankar University, Raipur) - Continuance of recognition in respect of students being trained at Pt.J.N.M. Medical College, Raipur. Read : The compliance report received from the Dean, Pt. J.N.M. Medical College, Raipur on the defects and deficiencies pointed out in the periodical inspection report (Sept., 96) for continuance of recognition of MBBS degree granted by Ravishankar University, Raipur. The Executive Committee noted that the Committee at its meeting held on had decided that a show cause notice be issued to the concerned authorities as to why steps should not be initiated to recommend to the Central Govt. to derecognise the institution for the award of MBBS degree for not sending the compliance report rectifying the deficiencies. The Committee also noted that one month's time was granted to the institution

5 for responding to the show cause notice and that a compliance has been received in response to the letter sent by the Council. As the details regarding the staff and other deficiencies have not been furnished, the Committee decided to send a copy of the obseravations prepared on the compliance to the authorities concerned for sending a detailed compliance for further consideration in the matter. The Committee also decided to write a D.O. letter to the Chief Secretary, Govt. of Madhya Pradesh for his information and necessary action. Copy of the letter be also sent to the Secretary (Health), Director of Medical Education and Member of the Council. 10. Inclusion of Blood banking as a subject in MBBS syllabus. Read : The request of Indian Association of Blood Bank for inclusion of Blood Banking as a subject in MBBS syllabus. The Executive Committee noted the representation received from the President, Indian Association of Blood Bank, New Delhi and decided to communicate that the matter is already covered under the subject of Pathology. 11. Review of Rules & Regulation of the Medical Council of India. Read : The report of the Sub-Committee constituted by the President of the Council to review the existing Rules & Regulations of the M.C.I. The Executive Committee accepted and approved the amendments suggested to the Rules and Regulations of the Medical Council of India. 12. Recommendations of the Committee set up by the Govt. of India (Ministry of Human Resource Development) - Regarding Text Books in Hindi/Regional Languages. Read: The letter dt.4th Sept., 1998 received from the Ministry of Human Resource Development, Deptt. of Education seeking comments of the Council "on the recommendations of the Committee to assess the work done by the various Grant Academies/Text book Boards/University cells and to consider the allocation of additional Central assistance to these organisations". The Executive Committee considered the letter dated 4th Sept.,1998 received from the Ministry of Human Resource Development, Deptt. of Education and was of the opinion that the present system of medical education be continued. However, this Committee has no objection for translating the medical books in Hindi and other regional languages. 13. Migration of Mrs. Vimla from Sind Medical College, Karachi, Pakistan to any Medical College in India. Read : The migration of Mrs. Vimla from Sind Medical College, Karachi, Pakistan to any Medical College in India as referred by the Migration Sub-Committee at its meeting held on 10/9/98. The Executive Committee considered the matter regarding migration of Mrs. Vimla from Sind Medical College, Karachi,

6 Pakistan to any Medical College in India as referred by the Migration Sub-Committee of the Council held on and decided not to allow the migration of Mrs. Vimla as there is no provision for migration from abroad to medical colleges in India as per the Migration Rules contained in the Regulations on Graduate Medical Education. 14. Migration of Km. Divya Nigam from Medical Institute Odessa, Ukraine to M.G. Instt. of Medical Sciences, Sevagram, Wardha. Read : The migration of Km. Divya Nigam from Medical Institute Odessa, Ukraine to M.G. Instt. of Medical Sciences, Sevagram, Wardha as referred by the Migration Sub-Committee at its meeting held on 10/9/98. The Executive Committee considered the matter regarding migration of Km. Divya Nigam from Medical Institute Odessa, Ukraine to M.G. Instt. of Medical Sciences, Sevagram, Wardha as referred by the Migration Sub-Committee of the Council held on and decided not to allow the migration of Km. Divya Nigam as there is no provision for migration from abroad to medical colleges in India as per the Migration Rules contained in the Regulations on Graduate Medical Education. 15. Modification of registration Certificate - Reg. Read : The recommendations of the National of the State Medical Councils organised by West Bengal Medical Council with regard to modification in the Registration Certificate issued to the Medical Graduates. The Executive Committee ratified the action taken by the President of the Council for incorporating the following in the registration certificates to be issued by the Council henceforth:- 1. Two photographs of the candidates be obtained - one to be kept in the file and other one to be pasted on the Registration Certificate. 2. Two self-adhesive slips of the size of approximately 2 inches x 2 inches be provided along with the application form for registration to obtain signature of the candidate. One of these signed slips be pasted on the Registration Certificate before the certificate is issued. 16. Govt. Medical College, Chandigarh - Recognition of the college for the award of MBBS degree granted by Punjab University. Read : The Council Inspectors report (6th & 7th Oct., 1998 for purpose of recognition of Govt. Medical College, Chandigarh for the award of MBBS degree granted by Punjab university. The Executive Committee considered the Council Inspectors report (6th & 7th Oct.,1998) and noted that the teaching staff which was earlier working on deputation basis from the neighbouring State now stands replaced with the regular staff appointed for Govt.Medical College, Chandigarh. The Committee also noted that the other infrastructure facilities such as beds, clinical material etc. is now adequate. In view of these facts, the Committee decided to recommend that Govt. Medical College, Chandigarh be recognised for the award of MBBS degree granted by

7 Punjab University with 50 (fifty) annual admissions. 17. Establishment of a new Medical College at Narketpalli, Nalgonda by Kamineni Education Society, Andhra Pradesh u/s 10A of the I.M.C. Act, Read : The Council Inspectors report 29th & 30th September, 1998 for establishment of a Medical College at Narketpalli, Nalgonda by Kamineni Education Society, Andhra Pradesh application of which was received through the Central Govt., Ministry of Health & F.W. The Executive Committee noted the order passed by the Hon'ble High Court of Hyderabad in W.P.No of 1998 in which the Central Govt. is also one of the respondents. The Hon'ble Court has directed the NTR University of Health Sciences, and MCI to evaluate the application submitted by the petitioner for the establishment of a private medical college at Narketpally, Nalgonda Distt., without awaiting the essentiality certificate pending consideration of the same by the Govt., pending further orders in the Writ Petition. The Committee further noted that the petitioner had also forwarded a copy of the letter dated to the Secretary, Ministry of Health & F.W., Govt. of India in reference to Ministry's letter No. U.12012/22/98-ME(P), dated clarifying their position on certain queries raised by the Central Govt. and further that Council office vide its letter dated requested the Central Govt. to send the application of the petitioner along with observations of the Central Govt. so that the Council may evaluate the application of the petitioner in compliance on the orders of the Hon'ble High Court. The Central Govt. forwarded the application of the petitioner vide its letter dated pointing out the following deficiencies existing in the proposal sent by the Society. 1. Essentiality certificate of the State Govt. with admission capacity has not been furnished. 2. Consent of the affiliating university with admission capacity has not been furnished. 3. Proof of ownership and possession of available land in the name of the Society have not been furnished. 4. Proof of ownership and managing 300 bedded hospital by the Society have not been furnished. 5. Authorisation letter addressed to the bankers authorising the Central Govt./Medical Council of India to make independent enquiries regarding financial track record of the applicant has not been furnished. The Committee noted that the Central Govt. in the said letter informed the Council that in view of the above deficiencies, the proposal is incomplete. However, in compliance of the Hon'ble High Court's order the Central Govt. had sent the proposal of the Society to the Council for its evaluation and recommendations. The Committee also noted that the Council office vide its letter dated has requested the Council Advocate to apprise the Hon'ble Court regarding the systems and procedure envisaged u/s 10A of the IMC(Amendment) Act under regulations notified thereunder and to seek the review of the order passed by the Hon'ble High Court at Hyderabad as per the

8 request of the Central Govt. In compliance of the orders passed by the Hon'ble High Court at Hyderabad and the proposal received from the Central Govt.,an inspection of the facilities available for establishement of the new medical college at the Narketpally, Nalgonda Distt., by Kamineni Education Society, Andhra Pradesh was carried out on 29th & 30th Sept.,98, the report of which is under consideration of the Committee. Noting the deficiencies pointed out by the Central Govt. existing in the proposal submitted by the Society for the establishment of the said medical college and further that the staff, available clinical material is deficient and no affiliation certicate has been provided by the NTR University, decided to recommend to the Central Govt. not to issue Letter of Intent for establishment of a new medical college at Narketpalli, Nalgonda by Kamineni Education Society, Andhra Pradesh. 18. Recognition of Ph.D. degree awarded by the Institutions other than the 29 instituions notified by the Central Govt., Ministry of Health & F.W. Read : The matter with regard to recognition of Ph.D. degree awarded by the Institutions other than the 29 instituions notified by the Central Govt., Ministry of Health & F.W. as referred by the Chairman, Registration & Equivalence Committee. The Executive Committee considered the matter with regard to recognition of Ph.D. degree awarded by the Institutions other than the 29 institutions notified by the Central Govt., Ministry of Health & F.W. and decided to refer the matter to the Postgraduate Committee of the Council for its consideration and also to review the matter of recognition of Ph.D. qualification of erstwhile USSR already included in the Schedule to the I.M.C. Act, Teachers Eligibility qualification - Appointment of Head of Department with Non-Medical qualifications in the Nonclinical Departments - Dr. Alka Gogale, Prof. & Head of Microbiology, LTM Medical College, Bombay and other similar matters. Read : The matter with regard to appointment of Head of Department with Non-Medical qualifications in the Non-clinical Departments - Dr. Alka Gogate, Prof. & Head of Microbiology, LTM Medical College, Bombay and other similar matters. The Executive Committee considered the matter as referred by the Teachers Eligibility Qualification Sub-Committee seeking clarification of the status of M.Sc. Medical Biochemistry as a basic qualification since many universities in the country do not award this qualification and further whether a case of a person who has done Ph.D. Biochemistry in a medical faculty, the basic necessity of doing M.Sc.(Medical Biochemistry) can be waived and M.Sc. in other related specialities like Zoology, Botany etc. be considered as acceptable qualification, instead of M.Sc. (Medical Biochemistry), decided that all the M.Sc. and Ph.D. should be obtained from medical faculty for teaching appointments in a medical college in non-clinical subjects where a provision has been made in the regulations to appoint teachers not possessing basic medical qualification. The Committee further decided that the matter regarding appointment of Dr. Alka Gogate and other similar matters be disposed of accordingly.

9 20. To note the change of name of the Victoria Jubilee Hospital (recognised by the Council for rotating internship training) as Sir C.M. Baronet General Hospital. The Executive Committee noted the change of the name of the Victoria Jubilee Hospital as Sir C.M. Baronet General Hospital, Ahmedabad. 21. Amendments to Graduate Medical Education Regulations, relating to marks in the professional examinations. Deferred item No.23 of the Executive Committee meeting held on 2/7/98. Read : The report of the Sub-Committee regarding reallocation of marks in the professional examination in the Regulations of the Council on Graduate Medical Education, The Executive Committee approved the amendments to Graduate Medical Education Regulations,1997 as suggested by the Sub- Committee constituted for the purpose regarding the reallocation of marks in the professional examination with the modification that the total marks for ENT and Ophthalmology be kept as Appointment of Dr. Sandip Kumar Mukherji as Deputy Secretary in the Council office - Approval of. The Executive Committee approved the appointment of Dr. S.K.Mukherji as Deputy Secretary in the Council office w.e.f in the scale of Rs /. 23. Appointment of Joint Secretary and Deputy Secretary (nonmedical) in the Council office on adhoc basis - Approval of. The Executive Committee approved the appointment of Dr. K.K. Arora as Joint Secretary in the Council office on adhoc basis in the pay scale of Rs.14, ,300/- and the appointment of Mr. A.S. Rahi as Deputy Secretary (non-medical) in the Council office on adhoc basis in the pay scale of Rs.12, ,000/ MBBS (Shivaji University) - Continuance of recognition in respect of students being trained at Govt. Medical College, Miraj. Read : The compliance report received from the Dean, Govt. Medical College, Miraj on the deficiencies pointed in the periodical inspection report (March, 97) for continuance of recognition of MBBS granted by Shivaji University. The Executive Committee noted that the Committee at its meeting held on had decided that a show cause notice be issued to the concerned authorities as to why steps should not be initiated to recommend to the Central Govt. to derecognise the institution for the award of MBBS degree granted by Shivaji University for not sending the observations on the remarks made by the Council Inspector in his report and that one month's time was granted to the institution for responding to the show cause notice. The Committee also noted that as per the request of the Secretary, Govt. of Maharashtra, Mumbai vide his letter dated , a period of three months i.e. upto was granted by the Committee at its meeting held on for complying

10 with the requirements in respect of Govt. Medical College, Miraj. The decision was communicated to the Secretary to Govt. of Maharashtra on with copy to the Dean, Govt. Medical College, Miraj and Registrar, Shivaji University and the DME, Govt. of Maharashtra. The Dean, Govt. Medical College, Miraj vide his letter dated and has submitted the compliance report on the deficiencies pointed out in the inspection report (March,1997), which is under consideration of the Executive Committee. On going through the inspection report, the Committee observed that deficiency regarding the staff is still persisting and decided to give final 3 months time to the institution to comply with the above deficiency and send a detailed list of staff members. 25. Inspection report of Khammam Medical College, Khammam run by Mamtha Educational Society, Khammam carried out as per the statutory regulations - consideration thereof. Read: The inspection report of Khammmam Medical College, Khammam run by Mamtha Educational Society, Khammam carried out as per statutory regulations. The Executive Committee noted that the institution was granted letter of Intent by the govt. of India on 16th October, 1997 to start a medical college with 100 annual admissions. The Council as per statutory procedure, on 15/12/97 had recommended to the Central Govt. for grant of Letter of Permission to the college. The permission for 100 admission was issued by the Central govt. on 19th May, 1998, stated to be with prospective effect. However, in the meanwhile the Council had received a copy of the order dt. 3/2/98 passed by the Hon'ble Andhra Pradesh High Court in Writ Petition No. 1413/98 filed by the College. The University of Health Sciences, Vijayawada, Govt. of Andhra Pradesh and the Central govt. through Ministry of Health & F.W. are the respondents in this Writ Petition. Medical Council of India is not a party to this writ petition. By this order dt. 3/2/98 the Hon'ble High Court had issued interim directions to the University of Health Sciences, Vijayawada to allot candidates to the petitioner's institution in the first MBBS course in accordance with the rules pending affiliation by first respondent Univ. without insisting on the permission of the Govt. of India. The Council had taken a legal opinion after receiving the copy of the order dt The Council was advised that since the Central govt. had not challenged the order dt. 3/2/98, the Council would be rquired to carry out the inspection for verification of achievements of the annual target in accordance with the statutory scheme. The copy of the above mentioned order dt. 3/2/98 was forwarded to the Central Govt. on 6/2/98 and the copy of the legal opinion obtained by the Council was forwarded to the Central Govt. by a letter dt. 3/9/98. Accordingly the inspectors of the Council carried out the inspection of the college on 7/8th Sept., As per the letter dt. 19/5/98 issued by the Central Govt. the college has been permitted to admit studetns only after 19/5/98 which would mean for the session However, during the inspection it has been found by the Inspectors of the Council that the students have been admitted by the college prior to the issuance of the letter dt. 19/5/98 by the Central Govt. granting prospectie permission to the College for starting

11 admissions. The Inspectors have also been given a letter dt. 14/9/98 by the Principal of the college categorically stating that 59 students out of the 100 were admitted prior to 19/5/98 and entire admissions process was completed by the college by 20/6/98. It is thus clear that the 100 admissions in the MBBS course by this college have been completed by June, 1998 and these admissions have to be treated as 100 admissions for the academic session as every academic session starts generally by August of every year. In view of this admitted fact that the process of 100 admissions was completed by the end of June, 1998 the college if not stopped from admittting 100 students again this year shall amount to admission of 200 students who would get admission and degree finally at the end of their MBBS course. This would completely defeat the entire object of the amendment act, Section 10A and the statutory scheme made thereunder. The Executive Committee considered the Council Inspector's report (Sept., 1998) alongwith the above facts and noted that the college is having substantial deficiencies even for providing training and education for 100 annual admissions for 1st batch. The Executive Committee decided to request the Central Govt. who is one of the respondents before the Hon'ble High Court to seek immediately appropriate corrective and other orders from the Hon'ble High Court by placing this factual position before it. 26. Migration of MBBS students to Govt. Medical College, Rohtak. Read : The matter with regard to migration of MBBS students to Govt. Medical College, Rohtak.
