1 1 M. J. Neeley School of Business Master of Business Administration, Master of Accounting, and Master of Supply Chain Management Programs Student Honor Code I. Purpose The graduate students of the M. J. Neeley School of Business have established this code for the primary purpose of instilling academic integrity, honor, and pride in the Master of Business Administration, Master of Business Administration for Energy Professionals, Master of Accounting, and Master of Supply Chain Management programs. It has also been established to: a) empower the student body to take an active role in strengthening the integrity and reputation of the TCU graduate business degree programs b) provide an avenue in which to turn when an incident of academic dishonesty occurs c) uphold due process and protect students rights The Honor Code Committee will investigate allegations regarding academic integrity and dishonesty, along with building awareness of the Code s importance. The Honor Code serves as the Neeley School s extension of the TCU Student Handbook. II. Responsibility All M. J. Neeley School of Business graduate students and faculty are responsible for reading, understanding, and upholding this code. Upon admission, each student makes an agreement with his or her fellow students to abide by the Neeley School Honor Code. It is the responsibility of the student body to uphold the Honor Code and encourage an ethical environment. A witness to a violation who does not report the act to the committee is considered in violation of the Code and will be held accountable. In addition, faculty members are expected to report all violations of the Honor Code to the Honor Code Committee. III. Faculty Cooperation In promoting the importance of the Honor Code, faculty should promote academic integrity among students, and must require all students to sign that they have upheld the Honor Code on all written assignments and exams. Faculty should also include their own interpretation of acceptable and unacceptable assistance on any relevant syllabus or assignment instruction for class. Faculty members are also invited to bring Honor Code suggestions to the attention of the Honor Code Committee.

Signature required on admission application B. START Workshop Honor Code Committee Member (Elections Officer) gives short explanation of the Committee s purpose and goals as well as a brief talk about elections for the Committee. C. Honor Code Statement on all Assignments and Tests Faculty may use the following written pledge on assignments (e.g. quizzes, examinations, etc.) as they see fit I have neither given nor received unauthorized aid on this assignment. (Signature). For electronic submissions, (e.g. , e-college drop-box, etc.), the typed pledge along with typed name(s) in the content and confirmed send shall count as honor code acceptance for the assignment. For group projects, the faculty member may accept either handwritten signatures or the typed format in a digital submission depending upon personal preference or assignment characteristics. V. Violations A. Cheating 1. Willfully giving or receiving unauthorized, unfair, dishonest, or unscrupulous advantage in academic work over other students by any means 2. Attempting any of the actions described in the preceding paragraph B. Plagiarism 1. Presenting the words, work, or opinions of another without suitable citation 2. Presenting a sequence of ideas, the arrangement of material, or the pattern of thought of another without suitable citation

3 3 C. Lying 1. The willful and knowledgeable telling of an untruth, as well as any form of deceit, attempted deceit, or fraud in an oral or written statement relating to academic work, résumés, or applications for employment within, or outside of, the university 2. Includes, but is not limited to, lying to administration and faculty members, falsifying any university document by mutilation, addition, or deletion; and lying to Honor Code Committee members and/or counsels during an investigation or hearing D. Failure to Report 1. Any student having knowledge of an Honor Code violation without reporting it will be considered an accessory to the violation and subject to penalty if found guilty 2. Every student and faculty member shall cooperate without reservation in aiding the Honor Code Committee to prevent, identify, and report Honor Code violations. All students, faculty, staff, and administrators requested to furnish information or evidence to the Honor Code Committee shall respond fully and truthfully to all inquiries E. Honor Code Violations Concerning Graduating Students In the event of a violation by a graduating student, the Honor Code Committee will attempt to resolve it in a timely manner. If a judgment cannot be reached during a reasonable amount of time, the case will be deferred to the Associate Dean of Graduate Programs to render a decision. (This amendment is designed to accommodate potential violations during or near the last weeks before graduation.) VI. The Honor Code Committee A. Composition of the Committee A total of seven graduate school students (to be drawn from all Neeley graduate programs excluding EMBA) will serve during an academic year. No more than 2 members per cohort (e.g. First year full-time MBA, Second year part-time MBA, Master of Accounting, etc.) may serve at one time. B. Role of the Committee 1. Interpreting the Honor Code. 2. Interpreting possible violations of the Honor Code. 3. Assessing the materiality of possible violations. 4. Making possible amendments or additions to Honor Code. 5. Promoting the values of the M.J. Neeley Honor Code.

4 4 6. Upholding the highest standards of honesty and personal ethics. 7. Recommending sanctions to Neeley faculty and administrators C. Appointment of the Committee An official announcement for volunteers will take place at the beginning of the academic year and students may apply for nomination. If an equal or lesser number of eligible students are available, the committee may mutually agree on committee positions. Any mutual group selfselection must be approved by the Graduate Programs Administration. If more students are in the nomination pool than available positions, an election will be held. In case of a tie, a run-off will be held. Different ballots will be held for part-time and full-time students. After the election, the student will serve one academic year on the honor code committee with the option to continue for a second year. Graduate faculty members of the Neeley School reserve the right to object to an applicant before nomination or selection. D. Officers of the Committee The positions are as follows: Chair, Vice Chair, Secretary, Professor Relations, Elections Officer and two Investigators. In the event that a committee member breaks the confidentiality agreement, the member will forfeit the right to serve on the Honor Code Committee. E. Job Description of Officers 1. The Chair of the Honor Code Committee will be responsible for coordinating activities of other committee members. He/she will act as the primary liaison to students and faculty for any information regarding the Honor Code. Job responsibilities will be delegated as needed by the Chair to other Committee members. He/she will call Honor Code Committee meetings as deemed necessary. During meetings, the Chair will act as the facilitator to follow meeting agenda. The Committee Chair will monitor progress towards Committee goals throughout the year. In the event of a charge, the Chair will be responsible for duties as listed in Section VIII Honor Code Committee Procedures. 2. The Vice Chair will support the Chairperson with any duties requested of him/her; represent the Honor Code/Honor Code Committee to the student body as a spokesperson; work with faculty and staff to further the objectives of the Honor Code; and represent the Honor Code and/or the Honor Code Committee at any appropriate staff/faculty meetings or functions. 3. The Secretary will document the minutes of Committee meetings and distribute to all members, and will update any approved amendments to the Honor Code and distribute to all graduate level faculty, the Neeley website manager, and graduate level students when applicable.

5 4. The Professor Relations Officer will inform faculty of the changes to the Honor Code, as well as handle all issues/complaints from faculty regarding the Honor Code. In the event of an allegation the Committee sees fit to investigate, the Professor relations Officer will be responsible for contacting faculty members to serve on the delegation committee. 5. The Elections Officer of the Honor Code Committee will be responsible for generating awareness of the Honor Code to first-year students each year at the START Workshop, and for soliciting applications to run for the Committee. 6. The Investigators will seek out evidence in the case of a charge. He/she will present all findings to the Honor Code Committee and during a hearing. If the appointed investigator is biased in any way, the position will be reassigned for that particular case. F. Meetings Meetings will be held for the purpose of training new Honor Code Committee members in the mission of the Honor Code Committee, its roles within the M. J. Neeley School of Business and its specific procedures in dealing with a breach in academic integrity. Meetings may also be held for administrative purposes. Any member who has missed two meetings during his term on the Honor Code Committee will have his/her position evaluated by the Committee and can be dismissed with a majority vote. Prior notice of the evaluation will be provided to the Committee member to allow for justification of the absences. Voting will be conducted in the absence of the member in question. The Chair, Executive Director of Graduate Programs, or Director of Graduate Program Administration will call meetings. G. Mock Neeley Graduate Programs Honor Code Trial The Honor Code Committee will hold its first meeting after the installation of new officers. During this meeting, or a subsequent meeting, a mock trial may be held to orient new officers on the proceedings of an Honor Code violation. (This will enable all committee members to be aware of committee proceedings in the event a violation occurs during the course of their office tenures). H. Summer Skeleton Crew During the time period of May (after graduation) to August (pre-new elections), remaining officers of the Honor Code Committee (those who have not graduated) will be expected to serve in their current capacities as committee members. The skeleton crew will enable the Honor Code Committee to cover all infractions during the summer months. Committee members who have not graduated will be expected to serve in the most available capacities. If members are unreachable, the Associate Dean of Graduate Programs may render judgment or defer judgment until new officers are installed in August. 5

6 6 VII. Delegation Committee A. Composition of Delegation Committee The Delegation Committee will be composed of three committee members, one graduate faculty, and the Executive Director of Graduate Programs. The three committee members: Chair, Vice Chair, and Secretary of the Honor Code Committee. The Executive Director of Graduate Programs will serve as a tiebreaker vote. If bias on the part of the Chair, Vice Chair, and/or Secretary is determined, another member from the Honor Code Committee will be chosen to stand in for him or her on the Delegation Committee. Bias will be determined by a vote of committee members not under scrutiny, with the Executive Director of Graduate Programs serving as tiebreaker. B. Role of the Delegation Committee Directly after an accused student has received his/her charge documents, this committee will convene to decide whether the student's professor or the Honor Code Committee will handle the incident. This decision will be made by a vote where the majority opinion will rule. VIII. Honor Code Committee Procedures A. Policy Statement The Honor Code Committee is not modeled after a court of law. Its hearings are not adversarial proceedings. TCU policy allows a student to bring any advisor he or she wishes to a hearing. If present, an advisor will only be permitted to advise the student. An advisor will not speak to the committee or cross examine any witness. B. Complaint Students, faculty members or other members of the M.J. Neeley School of Business are required to submit a complaint to the Honor Code Committee Chair regarding a breach in academic integrity. The accuser will remain anonymous unless he/she is the sole witness. The Honor Code Committee will then notify the Associate Dean of Graduate Programs, the Executive Director of the Graduate Programs, and the accused student s professor that a complaint has been filed. The statute of limitations for filing a complaint is as follows: a complaint must be filed by the end of the term in which the event occurred, unless the event occurs in the final two weeks of the semester. In the latter case, a complaint must be filed within the first two weeks of the next term.

7 7 C. Charges 1. Once the accusation has been made, the Secretary will serve the accused student with a charge document before any investigation begins. The charge document shall include the following: a. A brief description of the allegations b. The name(s) of the investigator(s) assigned to the case c. A brief outline of next steps, as well as a summary of the rights and responsibilities of the accused (NOTE: The accused should be referred to the most recent version of the full Honor Code Document for a complete understanding of rights and procedures) d. A means of indicating receipt of the charge document (NOTE: the charge document may be delivered electronically via campus with a Read Receipt, with a hard copy to be mailed to the student s address of record) 2. After the student has received the charge document, the Delegation Committee will convene to decide which of the two avenues the investigation will follow: a. Professor will investigate and deliver potential sanctions. OR: 1. The professor may pursue the investigation however he/she feels appropriate. Upon the culmination of the investigative process the professor is required to file the final decision and sanctions imposed with the Honor Code Committee. 2. The accused student may either accept the sanctions of the professor or appeal the sanctions to the Associate Dean for Graduate Programs. The appeal must be in the form of a written letter sent within five days of the professor s decision. Upon receiving the student s appeal the Associate Dean for Graduate Programs will decide on any appropriate follow-up actions. b. Honor Code Committee will investigate and deliver recommended sanctions to the Associate Dean for Graduate Programs. 1. The accused student is then requested to discuss the allegations with the Honor Code Committee appointed investigator(s) within 24 hours of when that investigator is appointed. NOTE: If unique circumstances prevent this discussion from taking place within 24 hours (e.g., allegations are filed during a holiday break), the meeting should be scheduled within the first 3 regular school days. 2. The accused student will not be given the names of student witnesses or a student complainant prior to the hearing, if a hearing is necessary. The Secretary will provide a copy of the charge to the complainant, who will also be requested to discuss the allegations with the Honor Code Committee appointed investigator.

8 8 D. Honor Code Committee Investigation The Honor Code Committee will appoint an unbiased investigator from the Committee to seek out the evidence in the case. 1. The accused is allowed to challenge the appointed investigator on the basis of personal bias and the Honor Code Committee will decide based on the evidence whether or not the investigator will continue with the Honor Code process and investigation. Any such challenge should be made within 24 hours of the time the accused has acknowledged receipt of the Charge Document. If personal bias is found, the Honor Code Committee will appoint another member of the council to investigate the charges.. 2. If possible, both elected Investigators will participate in the investigation, in order to reduce the likelihood of bias. 3. The investigation will be completed within an appropriate amount of time in order to ensure a fair and comprehensive investigation. The Honor Code Committee Chair and/or program director will determine the appropriate amount of time prior to beginning the investigation. Upon discovering evidence or the lack thereof, the investigator will present his/her findings to the Honor Code Committee. The investigator of the allegation will not participate in a vote determining the need for a hearing, nor will he/she give personal opinion on the accusation or the accused. However, he/she will be responsible for presenting the evidence to the Committee. The presence of the accused is not necessary. In order for the Committee to rule in favor of a hearing based on the evidence there must be a majority vote; four out of seven Honor Code Committee members must find the evidence sufficient, warranting hearing. During this time the accused will be allowed to: a. Conduct his or her investigation of the circumstances surrounding the reported violation. b. Interview any persons believed to have information relevant to the incident, in the presence of the appointed Honor Code investigator. If a student is unwilling to participate, he or she cannot be compelled to agree or to do so. c. Gather materials as evidence for a rebuttal in the event a hearing is required to be conducted.

9 9 E. Insufficient Evidence If it is determined that a hearing is not justified on the basis of insufficient evidence, the case is dropped and the accused, accuser, faculty, and the Director of Graduate Program Administration are informed of this decision by the Secretary of the Honor Code Committee. The anonymity of the participants shall be preserved. The Honor Code Committee will determine if evidence submitted during the hearing is insufficient. F. Hearing The purpose of the hearing is to determine if a violation of the Honor Code has been committed. The panel is comprised of all Honor Code Committee members, (excluding the investigator), one graduate faculty member, and the Executive Director of Graduate Programs. 1. The hearing will be held in private and the proceedings are confidential. The Chair of the Honor Code Committee shall enforce confidentiality via administration of an oral oath to all parties involved, and shall express frequent, emphatic reminders to all parties that confidentiality is to be maintained. 2. The accused student, investigator, student s professor and witnesses must attend the hearing. The accuser has the option to not attend unless he/she is the sole witness. 3. The Chair of the Committee will commence the hearing by reading the charge and any statements received from the complainant. 4. The investigator will give a report of his/her findings. 5. The Honor Code Committee will then be able to ask questions of the accused, complainant, and witnesses. 6. The investigator will remain at the hearing but will not participate in deliberations or vote with the Honor Code Committee panel. 7. The Secretary will record the events that take place and all facts presented. 8. After all appropriate testimonies have been heard, all parties except those on the hearing panel shall be dismissed, so that final deliberations and voting can be done in private. The faculty advisor sitting on the Honor Code Committee panel and Executive Director of Graduate Programs will hear the case only for the purpose of advising the Honor Code Committee when they are deliberating. Those voting on the case will only be the Honor Code Committee students (the investigator does not vote). All Honor Code Committee students are required to find the accused guilty in order to invoke a sanction. Each voting member should base his or her decision on whether there is a preponderance of evidence indicating that the accused student is guilty. A nonunanimous vote will remove the issue from the Honor Code Committee and the issue will be resolved by the Associate Dean for Graduate Programs.

10 10 G. Sanctions Sanctions that may be recommended by the Honor Code Committee may include, but are not limited to, any one or combination of the following measures: 1. Dismissal from the M.J. Neeley School of Business 2. Suspension from the M.J. Neeley School of Business 3. A failing grade in the course in which the student breached academic integrity 4. A zero on the compromised assignment 5. Community Service 6. A combination of the above 7. Other sanctions at Committee/Faculty discretion H. Determination of Sanctions Sanctions will be determined by a majority vote of Honor Code Committee members. A unanimous decision of guilty during the Hearing will result in the charged student being disqualified from serving on any TCU committee and the student will be placed on social probation (e.g. bar to Graduate Career Center services, forbiddance to attend C-level events, etc.) for a period of two years in addition to the sanctions applied by the Honor Code Committee. If a student is found guilty of two separate and unrelated violations of the Honor Code, the Committee will sanction the student with expulsion. Within two calendar days of the panel's decision, the Chair and Secretary will provide the charged person and the Associate Dean of Graduate Programs with written notice of the panel's determination of fact and recommended sanction. The Associate Dean of Graduate Programs may accept the recommendation of sanctions of the panel in whole or in part, or fashion a decision he or she feels is more appropriate. I. Appeal The charged student has the right to appeal the Honor Code Committee s ruling. The appeal process entails the following steps: 1. The appeal must be in the form of a written letter sent within five days of final decision to the Associate Dean for Graduate Programs, the Executive Director of Graduate Programs, and the Honor Code Committee. This letter should express the reasoning behind the appeal. Such reasons include: new evidence, realization of harmful bias in proceedings, violations of hearing procedures, etc. The Associate Dean of Graduate Programs will then decide whether or not to uphold the Honor Code Committee s verdict based on his/her own evaluation of the situation.

If the accused student wishes to appeal the decision of the Associate Dean for Graduate Programs, the appeal must be in the form of a written letter sent within five days of Associate Dean s final decision to the Dean of the Neeley School, the Associate Dean for Graduate Programs, the Executive Director of Graduate Programs, and the Honor Code Committee. The Dean will then decide whether or not to uphold the Associate Dean s verdict based on his or her own evaluation of the situation. 3. If the accused student wishes to appeal the decision of the Dean, the appeal must be in the form of a written letter sent within five days of Dean s final decision to the Provost and Vice Chancellor for Academic Affairs, Dean of the Neeley School, the Associate Dean of Graduate Programs at the Neeley School, the Executive Director of Graduate Programs, and the Honor Code Committee. The Provost will then decide whether or not to uphold the Dean s verdict based on his/her own evaluation of the situation. The decision of the Vice-Chancellor is not subject to appeal. J. Announcement on Violations The Secretary will be responsible for submitting an announcement to the Neeley community (including the graduate student body and relevant faculty and staff) about the proceedings. This announcement will not reveal the identities of the parties involved, including the members of the Hearing Panel. This announcement shall reveal: 1. The determination of fact by the student panel and a summary of the incident and material facts that led the panel to its decision 2. The final decision regarding sanctions 3. In the event that an accused person is found not guilty either by the student panel or by appeal, the Chair will allow the accused person to decide whether or not they would like an announcement made on their behalf 4. In the event that an accused person is found not guilty either by the student panel or on appeal, the accused person may request that an exoneration letter be prepared by the Honor Code Committee and given to the accused person for his/her personal records and use If there is a ruling of guilt, the Neeley School will place documentation in the student s official file to be held until graduation. K. Honor Code Revisions The Honor Code Committee will review the Honor Code each fall and will recommend revisions if needed. All changes to the Honor Code must be approved unanimously by the Honor Code Committee and are subject to faculty approval. 11
