1 2014 ADMISSIONS POLICY (FOR ADMISSION IN 2015) The 2014/2015 Admissions Policy for Constantia Kloof Primary School As a Section 21 Public School PREAMBLE The object and purpose of this policy is to give effect to Legislation, Regulations, Common law, and the Constitution in providing for Admission to Constantia Kloof Primary School for the 2014 academic year. This policy aims to ensure that Constantia Kloof Primary School admits learners within the constitutional prohibition against unfair discrimination. LEGISLATIVE FRAMEWORK Constantia Kloof Primary School s admissions policy conforms to the following legislation: # The Constitution of SA Act no 108 of 1996 as amended, # South African Schools Act Number 84 of 1996 as amended, # Educational Law Amendment Act 2002 (The amendment of SASA Section 5), # National Education Policy Act 27 of 1996 as amended, # Admission Policy for ordinary public schools General Notice 4138 of 2001, # Regulations for admission of learners to public School, 2013 # Norms and standards of funding, # Immigration Act 2002, # Refugees Act no 130 of 1998, # Provincial Acts, # Promotion of Administrative Justice Act 3 of 2000, # Aliens Control Act no 130 of 1991, # Case law, and # Relevant Bills. # Current Circulars The Principal and Governing Body are also aware of the regulations with regard to a school being deemed full in consultation with the District Director. 1. DEFINITIONS Constitution The Constitution of Republic of South Africa, Act 108 of Dept of Education The Department established by section 7(2) of the (GDE) Public Service Act, 1994 (Proclamation 103 of 1994), which is responsible for education in a province. Governing Body A Governing Body as contemplated in SASA, section 16(1).

2 Grade HOD Learner MEC That part of an educational programme which a learner may complete in one school year, or any other education programme, which the MEC may deem to be equivalent thereto. Head of an Education Department. Any person receiving education or obliged to receive education in terms of SASA. The Member of the Executive Council of a province who is responsible for education in that province. Parent a.) The parent or guardian of a learner b.) The person legally entitled to custody of a learner c.) The person who undertakes to fulfil the obligations of a person referred to in paragraphs a and b towards the learners education at school Principal Public School School An educator appointed or acting as head of a school. A school as contemplated in SASA, Chapter 3.SASA South African Schools Act 84 of A public school or an independent school, which enrols learners in one or more grades. Sibling Only biological brother/sister or step brother/sister, of a learner already enrolled at the school and living together permanently at the same residential address as the biological parent or legal guardian. 2. THE ROLE OF THE DISTRICT DIRECTOR The role of the District Director is acknowledged with regard to the administration and monitoring of registration as well as age above the age norm. The School s Admission Policy is submitted to the District Director, by the School Governing Body, for his/her information and certification. 3. THE ROLE OF THE SCHOOL GOVERNING BODY As the only juristic personality authorised to do so, this admissions policy was determined, compiled and accepted by the Constantia Kloof Primary School Governing Body, and it is understood that the policy will be revised annually. It is the Department s duty to respect and administer the school s admissions policy demonstrably, fairly and in accordance with the law. (NEPA 27 of 1996, Admissions Policy for Ordinary Public Schools, par 7. SASA Act No (5). Parents are encouraged, via school newsletter, school website, school communicator, s and SMS, to apply for admission between 7 April 2014 and 27 May Parents of learners are informed via the enrolment documents of their rights in terms of the South African Schools Act.

3 NB!! It serves to be noted that the Educators of Constantia Kloof Primary School will stand In Loco Parentis of the School s learners between 07:35 and 13:40 every official school day unless Parents are otherwise informed via newsletter, or verbally. It further serves to be noted that the School s capacity for learner enrolment will be as follows: A maximum of 37 learners can be accommodated per class room, due to the physical size of the classrooms and the practical implications thereof for the process of teaching and learning. The School will also take into account the number of ablution facilities and toilet bowls in those facilities in considering school and classroom capacity. The school will have 4 classes per grade, from Gr. 1 to Gr. 7. This implies that the school will accommodate a maximum of 148 learners per grade which, in turn, implies a maximum total enrolment of 1036 learners in the school. Notwithstanding this provision, the school reserves the right to reasonably exceed these numbers if deemed necessary by the Governing Body. 4. THE ROLE AND RESPONSIBILITY OF THE PRINCIPAL The Principal administers the admissions process in accordance with the School s admissions policy as adopted by the SGB. This includes the issuing of transfer cards forwarding learner information to new schools, keeping a register of admissions, maintaining the required waiting lists, liaising with District Admissions teams and forwarding data to the District Office as and when required. The Principal will ensure that no unfair discrimination takes place during the admissions process. 5. APPLICATION & CATCHMENT AREA It serves to be noted that the Government is obligated to ensure that each child of school going age is afforded their constitutional right to a basic education. However, this right does not extend to placement in a specific school being guaranteed. First time enrollers must apply for admission between 07 April 2014 and 27 May NB!! 1. Application forms must be completed and signed by the biological parent/s or legal guardian/s. 2. Constantia Kloof Primary School is an English medium School, and in its efforts to promote multilingualism offers Afrikaans as an additional language. Constantia Kloof Primary School however recognises that it is not equipped to deal with learners who are seriously challenged with regard to language development, and reserves the right to take this into consideration in applying its admission policy. 3. The School Governing Body reserves the right to take gender balance into consideration in order to ensure that Constantia Kloof Primary School does not discriminate on the grounds of gender, when admitting learners, even if this means that a learner with a lower waiting list number is preferred on this ground. A Waiting list A and a Waiting list B will be established as follows:

4 5.1. Waiting List A (the order below does not denote preference): 1. Learners, of school going age, whose parents/legal guardians reside permanently within the catchment area of the school. The school is thus the closest Primary School the learner is eligible to attend. 2. Learners, of school going age, who have siblings (see definitions) already enrolled at the school. This does not include learners who have siblings that are no longer enrolled at the school. 3. Learners, of school going age, whose parents/legal guardians are employed, fulltime and permanently, within the catchment area of the school, i.e. The school is thus the closest Primary School to the parents place of employment. CATCHMENT AREA DEFINED Having considered the application of Act No 6 of 1995 read together with Regulation 5, 2(a) and (b), which makes listing on waiting list A a possibility if that place of residence or place of work for that parent is within a 5km radius of the school, Constantia Kloof Primary School notes that there are 8 other Schools within a 5 kilometre radius, and consequently applies the closest school principle to 5.1(1) and 5.1 (3) above. In an effort to ensure that the catchment area is not arbitrary or prejudicial, Waiting list A catchment area shall be the halfway mark between Constantia Kloof Primary School and neighbouring schools that offer Primary School Education in English as LOLT (Language of learning and teaching) Waiting List B. Any other learners who do not qualify for admission in terms of 5.1. above will be considered for admission, provided that the school has space available after admitting all the qualifying waiting list A applicants. NB!! It has to be noted that it remains the parents responsibility to ensure safe, reliable and consistent transport to, and from, school every school day The SGB will adjudicate all applications. Applicants on waiting list A will be informed of the outcome of their application by no later than 27 June 2014 (tbc) and those on Waiting list B, will be notified by the District Office by no later than 27 June 2014 (tbc). The District Director will be kept abreast of progress made in this regard. (NB! Dates may change depending on logistics applicants to phone school to confirm) Consequences of admission The learner is admitted to the total school programme cultural, sporting and social, as more fully defined in annexure D. The learner may not be suspended from class, denied a school report or a transfer certificate or otherwise be discriminated against. However, Section 8(4) of SASA states: Nothing contained in this Act exempts a learner from the obligation to comply with the code of conduct of the school attended by such learner. The school subscribes to the GDE Inclusion Policy and referrals to Public Special and Specialised Schools are dealt with in accordance with Circular 35/2004

5 6. DOCUMENTS REQUIRED FOR ADMISSION OF A LEARNER 1. Unabridged Birth Certificate ( Normal birth certificate with application will be acceptable, but with registration the unabridged birth certificate is a compulsory SGB requirement) 2. ID documents of both Parents 3. Passport size colour photograph of the learner 4. Current Proof of Residence and/or confirmation of permanent employment 5. Immunisation Card 6. Latest School Report (Except for Grade 1) 7. Transfer Card (Except for Grade 1) 7. ADMISSION OF UNDER AND OVER AGE LEARNERS The following statistics for age norms apply: Grade 1 = Age 6 (turning 7) maximum age 8 Grade 2 = Age 8 maximum age 9 Grade 3 = Age 9 maximum age 10 Grade 4 = Age 10 maximum age 11 Grade 5 = Age 11 maximum age 12 Grade 6 = Age 12 maximum age 13 Grade 7 = Age 13 maximum age 14 as at 31 December. Learners are admitted to Grade 1 in the year in which they turn seven. Learners, who turn 6 before 30 June, may apply, as per the amendment to SASA (section 5 of Act 84 of 1996). It serves to be noted that learners, age 6 turning 7, on both Waiting lists, will be given preference over learners, age 5 turning 6 by 30 June. Over age learners must be carefully screened and consultation made with the District Director. Learners may not be retained in a specific phase more than once and then only after approval from the relevant District Official. 8. ADMISSION OF NON-CITIZENS 1. The admission of non citizens will be dealt with according to the relevant legislation and regulations. 9. REFUSAL OF ADMISSION OF A LEARNER 1. If a learner is refused admission to a public school, the Principal, acting on behalf of the HOD, must furnish in writing the reason for the refusal. The Principal must also provide the parent of such a learner with the address and telephone number of the District Office and the name of the District Director responsible. 2. Any learner who has been refused admission to a public school may appeal against the decision to the member of the Executive Council (MEC). 3. The Principal must furnish the parent with the address of the MEC. See Annexure C. 10. RE-ADMISSION OF LEARNERS Confirmation of re-enrolment of learners at Constantia Kloof Primary School is obtained annually.

6 11. RIGHTS AND OBLIGATIONS OF PARENTS 1. The Parent has the right to apply to enrol his/her child at a school of their choice, provided that that school s admissions criteria are met (for CKPS admissions criteria see point 5 of this policy). 2. The Parent has to ensure that the learner attends school regularly, has the correct school uniform and is wholly supported in the learning process. 3. Parents are obliged to pay the school fees as determined by the Parents at the annual Budget Presentation for Parents meeting as no school can function effectively without the set school fees being paid. Should a parent be unable to pay the said school fees, application must be made to the School Governing Body for a reduction/exemption of payment of the school Fees as approved by the Parent Body. 4. The supplying of fraudulent information and /or misrepresentation thereof, may affect your application and could lead to legal action taken by the SGB. In the event that the application contains fraudulent information or information that misrepresents a material consideration, the School Governing Body reserves the right to disregard the application and only consider an amended or new application as submitted on the date of the new, or amended, application. 12. ADMISSION POLICY CHALLENGE The School Governing Body has determined that any challenge to the validity or application of this policy shall be directed to the Chairman of the School Governing Body for consideration and response.
