2 S an José State University invites nominations and applications for the Title IX Officer for the Office of Diversity, Equity and Inclusion. THE UNIVERSITY San José State University (SJSU) is a major, comprehensive public university located in the center of San José, California the heart of Silicon Valley. A member of the 23-campus California State University (CSU) System, SJSU is the oldest state university in California. Its distinctive character has been forged by its long history, its location and its vision a blend of the old and the new; the traditional and the innovative. Among its most prized traditions is an uncompromising commitment to offer access to higher education to all persons who meet the criteria for admission, and to provide for and support a faculty that is active in scholarship, research, technological innovation, community service and the arts. SJSU grants bachelor s and master s degrees in more than 250 areas of study as well as an Educational Doctorate and a joint Doctorate of Nursing Practice. Quality teaching and small classes are a priority, where tenured professors teach introductory as well as advanced courses. Among the top 200 universities in research and development expenditures (as surveyed by the National Science Foundation), SJSU offers rigorous course work and research opportunities to more than 35,000 undergraduate and graduate students, with more than 800 tenured/tenure-track faculty, over 1,200 part-time faculty, and 1,400 staff and administrators. All faculty and most staff employees are represented by a union. 2

3 THE UNIVERSITY (continued) The unions represent the employees in the CSU system through collective bargaining agreements. The University community is proud of its cultural diversity across all constituencies. Accredited by the Western Association of Schools and Colleges (WASC), the University s academic colleges include: Applied Sciences and Arts; the Lucas College and Graduate School of Business; the Connie L. Lurie College of Education; the Charles W. Davidson College of Engineering; Humanities & the Arts; Science; and Social Sciences. The University offers 81 bachelor s degrees with 75 additional concentrations, and 70 master s degrees with 31 additional concentrations. The University has constructed or renovated several facilities in the last few years, and the campus occupies 19 blocks in downtown San José with 23 academic buildings and seven residence halls. Located 1.5 miles away on 62 acres is the South Campus, which includes the Spartan Stadium and athletics fields. MISSION In collaboration with nearby industries and communities, SJSU faculty and staff are dedicated to achieving the university s mission as a responsive institution of the state of California: To enrich the lives of its students, to transmit knowledge to its students along with the necessary skills for applying it in the service of our society, and to expand the base of knowledge through research and scholarship. 3

4 THE POSITION Reporting to the Chief Diversity Officer, Dr. Kathleen Wong(Lau), the Title IX Officer is responsible for the management of the comprehensive Title IX Program. In addition, the Title IX Officer ensures campus-wide implementation of and compliance with California State University Executive Orders 1096, 1097, and 1098, or any superseding executive order, state and federal Title IX laws, and all other applicable CSU, state and federal laws and policies. As the campus subject matter expert on Title IX programmatic activities regarding training, education, communication, complaint procedure administration, investigations, and best practices, the Title IX Officer has authority across all campus-based divisions and programs and, with the Chief Diversity Officer, is responsible for the development and implementation of campus policies and procedures, as well as the interpretation of Title IX laws and policies. The incumbent will be responsible for campus-wide Title IX education and communications, as well as the administration of complaint processes and procedures. He or she will conduct and/or coordinate investigations of complaints received pursuant to Title IX, ensuring a timely, thorough, impartial, and equitable process for all parties. The Title IX Officer must be committed to the principles of due process, fairness and respect. Reporting to the position is the Title IX Investigator. The SJSU community seeks a dynamic new leader to build upon a sound Title IX program at the University and embrace a fast-paced working environment with a young and diverse student population. The successful candidate will possess knowledge of current federal governmental direction and changes on Title IX issues, be able to quickly develop communication and trust with multiple campus partners and constituents, and provide hands-on leadership and management. 4

5 THE POSITION (continued) The Title IX position at SJSU is in the CSU - Management Personnel Plan (MPP), and the Title IX Officer serves at the pleasure of the President. This position may also require adherence to University compliance training such as: Conflict of Interest and Ethics, AB 1825 Sexual Harassment Prevention, Information Security, and Injury and Illness Prevention Program. The person hired for this position will be required to complete an outside employment disclosure statement in accordance with Title V of the California Code of Regulations. Responsibilities include but are not limited to the following areas Policy and Procedure Development and Management In collaboration with the Chief Diversity Officer, develop and implement campus- wide Title IX policies and procedures that address both the spirit and the letter of the law. Develop strategic initiatives; assess the effectiveness of campus efforts related to Title IX and implement corrective measures and solutions, as appropriate. Communicate all relevant policy and procedure information to campus. Ensure policies are adhered to while also ensuring procedures are followed as outlined. Interpret and apply Title IX laws and policies to ensure compliance. 5

6 Policy and Procedure Development and Management (continued) Ensure knowledge of Title IX laws and policies, and consult with CDO to modify campus policies and procedures as appropriate. Lead committees, as appropriate, to support Title IX initiatives and compliance. Maintain and update Maxient database for Title IX cases. Training, Education and Communications Develop and deliver campus-wide training, education, and preventive measures in the areas of sex discrimination, sexual harassment, sexual misconduct, dating or domestic violence, and stalking for students, staff, and faculty. Monitor, supervise, and oversee trainings for students, staff, and faculty regarding Title IX (e.g., employee obligations). Communicate all applicable Title IX information to appropriate parties. Develop informational materials to be distributed to the campus community and posted on SJSU s Title IX website ( Develop and maintain overall content for the Title IX website; ensure all appropriate policies, procedures and documents are easily accessible and up-to-date. Work with SJSU s Communications team on press and media interviews and communications. 6

7 Consultation and Investigation Receive and process all Title IX related inquiries and complaints from students, staff, faculty and third parties in a timely manner. Monitor, supervise, and oversee all complaints of sex discrimination, sexual harassment, sexual violence, dating or domestic violence, and stalking. Conduct investigations and/or assign investigations to campus Title IX Deputies and/or investigators, as appropriate, ensuring the timely completion and resolution of all investigations. Prepare and/or review investigation reports, containing the following: allegations, investigation procedures, preponderance of evidence standard, findings of fact, analysis and conclusion. Ensure that appropriate sanctions, strategies or recommendations are imposed for the resolution of complaints; work directly with disciplinary decision-makers. Facilitate reasonable interim measures and remedies, if requested and available to victims/complainants. Conduct assessment, write reports, and conduct analysis of statistics related to Title IX. Produce annual statistical reports regarding Title IX and collaborate with the SJSU University Police Department on the annual Clery Report. Monitor and report on trends and issues. Liasing and consulting with the University Survivor Advocate and Respondent Advocate. 7

8 Qualifications for the Position Education and Experience Required: A Bachelor s Degree in a related field, plus five years progressively responsible experience with Title IX processes, investigations and programs in a higher education environment. Preferred: A JD (Juris Doctor) degree or Master s degree, plus 2 to 4 years progressively responsible experience with Title IX processes, investigations and programs in a higher education environment. May consider 3 to 5 years of experience practicing as a licensed attorney in employment law in cases involving harassment and/or discrimination. Other preferred experience includes managing both compliance and education components of a Title IX program, working in Title IX investigative work at a large higher education institution, knowledge of CSU Executive Orders and experience in the CSU System. Knowledge, Skills & Abilities Strong knowledge of CSU Executive Orders, state and federal Title IX laws and policies. Strong knowledge of training and communication methods. Excellent oral, written communication skills, and presentation skills. Excellent project planning skills. Strong interviewing and investigatory skills. Strong organizational, critical thinking and analytical skills. Proven awareness and demonstrated skills in the area of cultural responsiveness. Ability to interpret and communicate policy information to a wide variety of constituents in concise, logical and grammatically correct reports that convey complex and sensitive issues. Ability to communicate to a diverse campus community in a variety of methods in assessing procedural, policy or ethical concerns in complex matters. Ability to build relationships that balance the multiple, varying and sometimes conflicting interests of a diverse campus community. Ability to provide impartial consultation, conflict resolution and problem solving in response to the campus community. Ability to manage multiple priorities. 8

9 Knowledge, Skills & Abilities (continued) Ability to use independent judgment when making decisions and recommendations, and maintain neutrality in the face of resistance, indifference or hostility. Ability to work under pressure and meet deadlines. Ability to effectively facilitate meetings and collaborate with relevant stakeholders. Ability to work collaboratively with other staff. Ability to maintain strict confidentiality when conducting Title IX training, education, communications, investigations, reporting and other interventions. Ability to demonstrate sensitivity, knowledge, and understanding of the diverse academic, socioeconomic, gender, cultural, disability, and ethnic backgrounds of the students, faculty, staff, administrators and university stakeholders we serve and sensitivity to and knowledge and understanding of groups historically underrepresented, and groups who may have experienced discrimination. 9
