3 Page 1 Statement to Accompany the Attached Resolution At the end of the academic year, in response to growing concern about the tenure process in Arts and Sciences, the Faculty Council submitted a discussion document to the Provost and the incoming Dean of Faculty. That document was subsequently circulated to the faculty (March 1985). The present resolution is the result of recent discussions stemming from the issues raised in that earlier document, and supercedes it. We believe the procedures recommended here address the most significant of those crucial issues, and we invite the faculty's attention to our suggestions. Faculty Council 15 April 1985

4 Page 2 Resolution A Be it resolved that: 1. There shall be a Committee on Tenure and Promotions consisting of twelve, tenured, full professors, four from each of the three divisions. The Advisory Committee on Personnel shall cease to function when the Committee on Tenure and Promotions has been elected. 2. Each member of the Committee shall serve three academic years, one or two members from each division being elected each year in accordance with the provisions of paragraph 12 below. Full-time members of the Faculty shall elect Committee members in a secret ballot to be taken by mail. 3. The Faculty Council shall present to the Faculty for ratification at a regular or special meeting two nominees for each place to be filled. At that meeting, the Faculty shall have the right to add nominees to the list of candidates. No more than one person from a Department may be a member of the Committee on Tenure and Promotions at any one time. 4. Each year the Committee on Tenure and Promotions shall select one of its members as chairperson for that year. The chairperson shall receive a copy of departmental recommendations for tenure and promotions with all supporting documentation, including the Departmental Guidelines on tenure and promotion. 5. The Committee on Tenure and Promotions is charged, inter alia, with conducting an independent evaluation of the substantive merits of recommendations for promotion and tenure. a) A critical review of the department's recommendation shall be prepared by a subcommittee consisting of three voting members of the Committee on Tenure and Promotions augmented, if deemed necessary, by one or two individuals chosen from within the Committee and/or outside the Committee. Such persons may be selected from the Washington University Faculty or elsewhere The composition of the subcommittee shall reflect substantial representation from cognate disciplines. A member of the candidate's department who is also an elected member of the Committee may not serve on the subcommittee assigned to that case, but may participate in the discussions of the full Committee and may vote. b) The Chair of the full Committee shall appoint each subcommittee after conferring with the Dean of the Faculty and the Chair of each candidate's department. c) The subcommittee may solicit expert advice and professional counsel in any manner that it deems most appropriate. d) The Dean of the College of Arts and Sciences, the Dean of the Graduate School and the Dean of University College shall regularly and routinely advise the Committee on matters relevant to their offices. 5 Page 3 Resolution A (Cont'd) e) Each subcommittee shall prepare a written summary of its investigations and shall present it to the full Committee. All of the information gathered in the course of the investigation shall be available to the Committee. f) Departments shall, at their discretion, be represented by one of their tenured members at those meetings of the full Committee on Tenure and Promotions that involve substantive deliberations of a member of that department. g) The Dean of the Faculty of Arts and Sciences shall be a non-voting member of the Committee and shall attend and participate in the substantive deliberations of the full Committee on Tenure and Promotions. h) All deliberations of the Committee on Tenure and Promotions as well as its subcommittees shall be in camera and confidential 6. The recommendation of the Committee on Tenure and Promotions shall be determined by secret ballot of its elected members. The recommendations, accompanied by the division of the vote, shall be forwarded in confidence and in writing to the Dean of the Faculty and the chairperson of the Faculty Council. Notification that a recommendation has been reached, and whether the recommendation is positive or negative, will be conveyed to the candidate and to the chair of the candidate's department. Upon request, the division of the vote in the event of a negative decision may also be provided to the candidate and to the chair of the candidate's department. 7. Upon receiving the recommendation from the Committee, the Dean shall review the candidacy and transmit his decision--in writing and with statements in support of his decision--to the candidate, the chairperson of the candidate's department, the chairperson of the Committee on Tenure and Promotions, and the chairperson of the Faculty Council. 8. Copies of all correspondence as well as records of verbal evaluations solicited and used by the Committee on Tenure and Promotions in reaching its decisions shall be made part of the permanent record of the procedure, and will be available if necessary to standing review committees of the Faculty and of the University. 9. Reconsideration of denials of tenure or promotion will be undertaken by the Committee on Tenure and Promotions only if, in the opinion of either the Dean of Faculty or the Committee on Tenure and Promotions, substantial new evidence bearing on the candidacy becomes available. 10. The Committee shall report annually on its work to the Faculty Council and to the Faculty at large, taking care that the usual safeguards of confidentiality are preserved. Individual members of the Committee may communicate their own views on the workings of the Committee to the Faculty Council. 11. Nothing in the above paragraphs shall be construed to prejudice the rights of faculty members to appeal to the appropriate Faculty and University committees charged with reviewing tenure and promotion decisions.

6 Page Transitional and electoral provisions: a) Of the first twelve members, four shall serve one year, four for two years, and four for three years. Thereafter, beginning with the second year, one-third of the members shall be replaced each year. To maintain the divisional balance on the Committee, from the second year onward the annual electoral slate (of four positions) shall include two places from the same division in a rotation to be determined by the Faculty Council. b) This Committee shall come into operation in the academic year. The deadline for receipt of departmental recommendations by the Committee shall be November 1 of each year. c) Elected members of the present Advisory Committee on Personnel shall complete their terms as members of the new Committee on Tenure and Promotions.

7 Resolutions B and C Statement of Explanation to Accompany the Attached Resolutions Many faculty members have eloquently voiced their concerns recently about the standards and procedures governing in tenure matters in the Faculty of Arts and Sciences. There has been constructive discussion of various reforms of the procedures for review of tenure. However, there has been little discussion of specific actions to clarify for junior faculty the standards that are currently being applied in tenure decisions. The Washington University Policy on Academic Freedom, Responsibility and Tenure explicitly requires that faculty members on probationary appointments be advised in writing about the standards to be applied in tenure cases. However, such standards have not been spelled out in writing or communicated to faculty members on probationary appointments. In order to implement the requirement of the tenure document it is necessary that the faculty take two steps: 1) decide what the standards for tenure are, and 2) communicate them to the probationary appointees. The two resolutions attached are designed to insure this. This is a particularly propitious moment for these actions since the Dean, in letters denying tenure this year, has enuciated with relative clarity a set of standards for deciding tenure cases. The first resolution places before the faculty the issue of standards for tenure--not just procedures or criteria. The resolution invites the faculty to affirm the Dean's standards as stated in tenure letters this year. This resolution should be rejected if the Dean's standards are not the standards the Faculty itself would choose to apply. Such a rejection would, of course, have no effect whatsoever on the constitutional authority of the Dean with respect to his decisions not to forward tenure recommendations. In the event of a rejection, there would clearly be a need for the Faculty to give immediate and serious attention to the issue of standards for tenure decisions in addition to the issue of procedural reform. The second resolution guarantees that junior faculty and job candidates for "tenure track" jobs in the Faculty of Arts and Sciences will be fully informed about tenure standards. This resolution would also require that the Dean's standards be made known. This resolution should not be rejected on any grounds since it merely implements the guarantee stated in the tenure document that relevant information be provided to junior faculty. 8 Comments on Resolution B The standards to be used in granting tenure should be as clearly stated and understood as possible in order to conform to the requirements of the Washington University tenure documents. The Dean of the Faculty of Arts and Sciences has, in recent tenure decisions, clearly enunciated standards for awarding tenure. The Faculty of Arts and Sciences can easily meet the requirements of the tenure document by formally adopting the standards enunciated by the Dean (which are incorporated in this resolution). Resolution B Be it resolved that: It is the standard of the Faculty of Arts and Sciences that candidates shall be deemed qualified for tenure if and only if the candidate: a. has demonstrated an ability to do path-breaking work of the sort that captures the attention and arouses the unsolicited admiration of professional colleagues, and b. is expected to be a leading figure associated with important new developments in his or her discipline over the next several decades.

9 Comments on Resolution C The Washington University Policy on Academic Freedom, Responsibility and Tenure requires, in section VI-B-1-a that each faculty member on a probationary appointment "shall be advised, in writing, by his chairman or dean, prior to his appointment, of the substantive... standards generally employed in.. granting of tenure." The same document, in Section V-B specifies that the status of faculty members on probationary appointments shall be reviewed annually, and that this review shall include an evaluation of "his prospects for future employment including tenure at the University." In order that faculty members on probationary appointments and candidates for tenure track jobs may be fairly and fully informed about the standards to be applied in tenure decisions; Resolution C Be it resolved by the Faculty of Arts and Sciences that: a. the Dean should inform department heads and program directors, in writing, as fully and precisely as possible, of the standards he will apply in review of departmental tenure recommendations, and b. unless informed by the Dean in writing that he plans to apply other standards, department chairs and program heads shall assume that the Dean's standards for tenure are such that in order to be qualified for tenure, a candidate must: 1) have demonstrated an ability to do path-breaking work of the sort that captures the attention and arouses the unsolicited admiration of professional colleagues, and 2) be expected to be a leading figure associated with important new developments in his or her discipline over the next several decades, and c. faculty members on probationary appointments shall be advised of the Dean's standards for tenure and any other relevant departmental or program standards for tenure: 1) at the time of the offer of employment, 2) with each contract renewal, and 3) in each annual evaluation, and that d. candidates for jobs designated as "tenure track" jobs in the Faculty of Arts and Sciences must be informed of tenure standards in all advertisements of the opening, including letters soliciting applications, and in a note acknowledging receipt of the application.
