2 VISION STATEMENT NAGLE COLLEGE VISION AND MISSION Nagle College is the Catholic Secondary College of East Gippsland. We are a community of students, families and staff which has Jesus Christ and his message of love, hope and service as our underpinning value. We work together to develop the whole person ensuring their spiritual, intellectual, physical and emotional growth enabling all to Let Their Light Shine. 3 Aim of the College Council The aim of the College Council is to promote the educational goals of Nagle College as a Catholic School and to collaborate with the Church in its mission of spreading the Good News of the Gospel. As a Catholic School Nagle College operates upon the following premises: (a) (b) (c) (d) (e) (f) (g) (h) (i) (j) That Christ is the foundation of the educational enterprise; That the Gospel is the basis of Christian learning, not only for individuals but for the whole school community and requires a care for the poor, the inclusion of all and a recognition of diversity within our community; That we follow our Catholic heritage, culture and tradition; That the College is in relationship and interaction with the Diocese of Sale and the Parish Communities of East Gippsland; That we follow the Charisms of St John Bosco (Salesians) and Nano Nagle (Presentation Sisters); That we abide by the policies developed by the Catholic Education Commission of Victoria, the Catholic Education Office, and within the Salesian educational tradition; That we recognise the role of parents as the primary educators of their children and with whom we collaborate; That we aim to provide a quality education for all students; That we exercise stewardship of College resources; That the requirements of Canon Law are met. \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 3 of 13

4 1 PREAMBLE: 1.1 With the approval and under the direction of the Bishop of Sale, Nagle College has been established within the Diocese of Sale to provide Catholic education, according to the precepts, teachings and practices of the Catholic Church. This college is administered by the body comprising the member parish priests of the College Region (the Canonical Administrators) according to the statutes approved by the Canonical Administrators and ratified by the Bishop and is acknowledged as Catholic by his authority. (See Section 2 below) 1.2 According to the provisions of Canon Law and their particular applications in the Diocese of Sale, this College shall follow the guidelines for religious education, as approved by the Bishop and is subject to such other directions and guidelines which may be given from time to time by the said ecclesiastical authority in accord with the Canon Law. (Canons ) 1.3 The College is managed by Nagle College Council under delegation from the Canonical Administrators, in accordance with the constitution which is approved by the Bishop. According to the provision of Canon Law the College Council acts as a Board of Management, and is responsible to the Canonical Administrators who in turn are subject to the vigilance of the Bishop. (Canon 1279) 2 MEMBERSHIP OF THE REGION: 2.1 The Parishes comprising the region served by Nagle College shall be as follows: Bairnsdale/Omeo Lakes Entrance Orbost 2.2 If a Parish is established within the regional area, it shall be deemed to be part of the region. 2.3 A member Parish, wishing to leave the region, shall apply to Council, which, if it approves of the application, may recommend to the Bishop that the request be granted. 2.4 The Bishop of Sale shall have and retain the final power to add or remove Parishes from the region served by the College. \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 4 of 13

5 3 OWNERSHIP: Ownership of the land and buildings of the College shall be vested in "The Roman Catholic Trusts Corporation for the Diocese of Sale" on behalf of the member Parishes and according to the Agreed Formula. The agreed formula being: Bairnsdale 77%; Lakes Entrance 17%; Orbost 4% and Omeo 2%. 4 PROVISION OF LAND, BUILDINGS AND CAPITAL WORKS: 4.1 Financial arrangements for the provision of Capital Works, such as additional land, and buildings comprising buildings equipped to satisfy the requirements of a secondary college shall be the responsibility of Council exercised on behalf of the Canonical Administrators. 4.2 If capital funds for these purposes are sought from member Parishes, once the requirements set down below have been met, they shall be provided after the agreement of the member Parishes is obtained and according to the Agreed Formula. 4.3 Along with preparing the necessary feasibility studies and capital budgets, Council shall make appropriate referrals to the Canonical Administrators for those items set out in the Statute for Canonical Administrators of Nagle College. 5 COLLEGE COUNCIL COMPOSITION: 5.1 Council shall be composed of: i) A Chairperson who will be appointed in accordance with the attached 'Appointment of Chairperson'; ii) iii) The Principal or if not available the Acting Principal of the College; Each Parish Priest of the region or his nominated representative, the representative being a full voting member. Each Parish Priest will maintain the right to attend meetings of the Nagle College Council. If, on such an occasion, the Parish Priest wishes to vote on a matter, his nominated representative shall forgo their vote on that occasion. iv) A nominee of the Director of Catholic Education of the Diocese of Sale; v) Six (6) parents, elected by the parents of the pupils attending Nagle College; \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 5 of 13

6 vi) Up to four (4) additional members may be co-opted by the Council for such a period of time as Council determines but for no longer than a maximum of three (3) years. If the chairperson is nominated from outside the council, the number of co-opted members shall be reduced by one. 5.2 Council shall meet at least six (6) times a year. 5.3 Council meetings shall proceed under the normal rules for conducting of meetings. 5.4 A quorum for a validly constituted meeting of Council shall be at least half the total membership of Council in the particular year plus one. 5.5 Decisions of Council shall be determined by a simple majority of members present, except in the case of changes in the Constitution. (See Clause 17). In the event of a tied vote, the motion shall be lost. 5.6 The agenda for meetings and minutes of meetings shall be sent to Council members. 5.7 No paid employee of the College may be a Parent Representative on Council. 6 GENERAL RESPONSIBILITIES: The responsibilities of the Council are: 6.1 To ensure that the operation of the College is consistent with the pastoral responsibilities held by the Canonical Administrators by receiving regular reports from the Principal. 6.2 To assist the Principal in the formulation of College Policy. 6.3 To assist the Principal in carrying out the following responsibilities: a) Promoting the Catholic ethos of the College b) Administering the educational programs of the College c) Developing an appropriate curriculum and maintaining academic standards d) Maintaining school discipline within the pastoral criteria established by the Council e) Ensuring the care and maintenance of College plant 6.4 To assist the Principal in the area of finances within the parameters set out below: a) Monitoring financial management b) Approving the Annual Budget in accordance with Diocesan Policy c) Receiving the Report of the College Auditors d) Reviewing the overdraft e) Reviewing investment policies \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 6 of 13

7 f) Approving all capital expenditure and leasing agreements within the limits specified by the Canonical Administrators g) Setting the annual tuition fee schedule h) Advising the Principal in raising loans 6.5 To seek approval from the Canonical Administrators for the disposal or acquisition of property. 6.6 To receive a report on College insurance policies every three (3) years. 6.7 To assist with planning for the present and future operation of the College. 6.8 To plan, implement and evaluate the financial and building programs necessary for the recurrent and long term effectiveness of the College in accord with Council s responsibility to consult appropriately with various Diocesan and civil authorities. 6.9 To provide representation, as required, for the appointment of a Lay Principal To make itself aware of the needs and aspirations of parents, students and other interested groups for the purpose of carrying out its responsibilities Council, at its first meeting for the year, shall appoint an auditor who will report annually to Council on the financial management of the College The Financial Statements and budget are to be forwarded by Council to the Canonical Administrators for approval. The Canonical Administrators are responsible for forwarding the approved budget to the Bishop through the Director of Catholic Education. Deficit funding of the budget is only allowable with the approval of the Canonical Administrators. 7 COMMITTEES: 7.1 The College Council shall establish a Management and Finance Committee each year which: i) Formulates recommendations pertaining to financial policy, including fee scale; ii) iii) iv) Presents an audited account of income and expenditure for previous year; Monitors budget and advises on financial management and the maintenance of all College property; Advises on building projects and the financing of capital development; \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 7 of 13

8 v) Monitors government policy developments relating to funding and other resources for education; vi) Assists Council carry out its responsibilities in relation to the financial management of the College. Membership: Chairman, Principal, Business Manager (non-council member) and up to four other members of Council. 7.2 The Council may establish other Committees for specific purposes and with a specific time limit to address issues as they arise. The membership of these committees may include Council members and other non-council members as invited. 8 SPIRITUAL MINISTRATION: 8.1 A Chaplain may be appointed by the Bishop of the Diocese. 8.2 Each Parish Priest or his representative shall have the right to address the pupils of his Parish regularly during the school year and to interview individual pupils by arrangement with the Principal. 9 ENROLMENTS: 9.1 All Catholic boys and girls who reside within the member parishes and who have satisfactorily completed the Grade Six course shall be eligible for enrolment. Exceptions in individual cases may be approved by Council. 9.2 Applications for enrolment shall be made to the Principal who shall enrol pupils according to the policies and conditions of College enrolment guidelines. (Attachment No 2) 10 THE PRINCIPAL: 10.1 The Principal will be responsible for: a) The Catholic ethos of the College, its maintenance and promotion b) The Administration of the College c) The selection of staff d) The curriculum including the Religious Education Program e) The academic standards f) The Pastoral Care (including discipline and management) of staff and students g) The implementation of the Policies of the Council 10.2 The Principal must have regard to the College budget in determining the employment of staff and the appropriate level of staffing for the College. \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 8 of 13

9 10.3 In the instance of an appointment by the Bishop of Sale of a Religious Congregation the Provincial of that Congregation after appropriate consultation with the Bishop of Sale, shall appoint a Principal In the instance of the appointment of a Lay Principal the guidelines for the selection of a Principal as laid down by the Catholic Education Office, Diocese of Sale, and the CECV (Catholic Education Commission of Victoria) shall be followed. 11 STAFF: 11.1 College staff are employed by the Principal on behalf of the Canonical Administrators of the College The conditions of employment of the professional teaching staff shall be in accordance with the determination of The Victorian Catholic Schools and Catholic Education Offices Award Non-teaching staff shall be employed under such awards and agreements as shall from time to time be applicable to the position for which they are employed Lay staff wishing to resign shall give as much notice as possible but must at least meet all the obligations required of them under their relevant awards. In exceptional circumstances the Principal may waive such obligations. 12 AUXILIARY ORGANISATIONS: 12.1 The establishment and operation of auxiliary bodies of the College must be in accordance with the directions of College Council No auxiliary organisation, with the exception of the Canteen, shall engage in fund-raising activities without the approval of Council. 13 ELECTION OF PARENT MEMBERS: 13.1 Election of parent members shall be held during Term Three. The term of office for each parent member shall be a period of three (3) years If a casual vacancy of parent members occurs, Council may fill that vacancy by co-option until the next election To ensure continuity, elections shall follow at three (3) year cycles with two (2) parent members being elected each year. 10 14 REQUIREMENTS TO ATTEND MEETINGS: 14.1 Council members are required to attend all Council meetings. Where any elected or co-opted Council member is absent without leave for three (3) meetings in any twelve-month periods his/her membership of Council shall be deemed to have ceased Council may in exceptional circumstances agree to waive this requirement A member of Council may, in writing, appoint a fellow member of Council to represent him/her as proxy on Council for a single meeting. 15 ENROLMENT GUIDELINES: as attached 16 CHANGES OF CONSTITUTION: 16.1 Notice of any proposed change in the Constitution shall be given to Council members in writing 14 clear days in advance of a special Council meeting called specifically for the purpose of determining the matter The Constitution may be changed provided that: i) Seventy-five percent of the members present in person or by proxy agree; ii) The Association of Canonical Administrators of Nagle College agree with the proposed changes. iii) The Bishop ratifies such a change If the change in Constitution is approved according to 16.2 (i) above, it will immediately be referred to the Bishop for ratification by the President of the Canonical Administrators. 17 THE DISSOLUTION OF THE COLLEGE: 17.1 If upon the winding up or dissolution of the College (other than for the purpose of reconstruction, amalgamation, or re-organisation of the College), there remains after the satisfaction of all its debts and liabilities any property pertaining to Nagle College whatsoever, the same shall be paid or distributed to the member parishes, according to the agreed formula or other appropriate document. If possible, this should be used for purposes similar to those of the original foundation, namely Catholic education. Any disputes arising from such dispersal shall be referred to the Bishop for arbitration If upon the winding up or dissolution of Nagle College there remains any unsatisfied debts, these shall be met by the member parishes according to the agreed formula. -ooo- \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 10 of 13

11 ATTACHMENT: 1 APPOINTMENT OF A CHAIRPERSON i) AIM: To obtain the services of the most competent person available from within the College region. Who, meeting the criteria listed in the Constitution, has the willingness and capacity to lead the College Council, in best serving the educational administrative needs of Nagle College, in particular Catholic secondary education generally within its region. ii) a) The procedures for the selection and appointment of a Chairperson to this council should begin prior to the conclusion of the incumbent Chairperson's term of office; b) Council will, after careful evaluation, select from nominations the person, who in its view, is most suited to the position of Council chairperson; c) The term of office of the Chairperson shall be three (3) years; d) The retiring chairperson shall be eligible for re-appointment; e) Should the College Council appoint a Chairperson from outside its own members, then the person so appointed shall automatically become a member of the Council in accordance with clause 5.1 (vi). iii) CRITERIA TO BE TAKEN INTO CONSIDERATION: When considering candidates the Council should seek persons who:- a) Demonstrate leadership qualities and are well-respected within the College region; b) Are committed Catholics with the trust and respect of parishes within the region and the College community; c) Have a knowledgeable appreciation of the complexities of Catholic secondary education; d) Would eschew factionalism where the interests of the College are involved; e) Know meeting procedures, have an ability to chair meetings and to involve Council members in discussions and decisions on a consensus basis. \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 11 of 13

12 ATTACHMENT: 2 COLLEGE ENROLMENT GUIDELINES Nagle College has been established by the Catholic community of East Gippsland to provide a full secondary education, including an appropriate religious education for Catholic young people in this area. The College is therefore expected to accept the enrolment of all eligible Catholic students. Given the demand for places at Nagle, the following guidelines are set, in the event the demand for places exceeds their availability. Enrolment of Catholic Students: i) Priority of access is given to Catholic students. ii) iii) iv) Generally, neither the intellectual nor academic ability of the Catholic child seeking a place at Nagle College, is a criterion of entry. Whilst the degree of faith commitment of the child's parents is a relevant consideration, it should not be a criterion for enrolling a child at Nagle College. Catholic children should not be excluded from Nagle College because their parents are unable to pay school fees. Enrolment of non-catholic Students: Students other than Catholic have always sought enrolment at Nagle College and have been admitted when class vacancies existed. It is recognised that non-catholic students add their own special dimension to Catholic education. They bring with them their Christian traditions, such as knowledge of the bible, Christian commitment and a particular spirituality which can add to the enrichment of the school community. Nagle College also has an evangelising role and this may find expression through the enrolment. Nagle College policy regarding the enrolment of students who belong to other Christian faith traditions is in accordance with the guidelines below. \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 12 of 13

13 Children of other Christian faith traditions will be enrolled at Nagle College if: i) Their enrolment does not exclude Catholic children from the College; ii) iii) iv) Class sizes at the relevant year level are within acceptable limits; Their parents undertake to respect the nature, life and identity of the school, and their children will participate in the Religious Education programme of the College; Once enrolled in accordance with these guidelines, they have the right to complete their secondary education at Nagle College; v) They have or have had siblings enrolled at the school. They will receive special consideration as the College believes it has established an educational relationship with the family; vi) Children of the Greek Orthodox faith and other Orthodox Christians are recognised as students deserving special consideration, particularly where the sacramental life of the school community is concerned. -ooo- \\dory\office$\leadership\administration\meetings\council\college Council Constitution\Constitution as at July 2006.doc 13 of 13
