11 Annexure - II Conditions of Contract 1. The validity of the contract is for the period of one year from the date of approval of order / contract. 2. The publication of advertisement shall be within hrs in the news papers all over India. 3. No payment shall be made in advance. 4. The Agency shall be responsible for any loss caused due to delay in publication of advertisement. 5. No charges for designing of operational advertisements will be paid. 6. Approval of design in hindi and English both budget and newspapers before publication will be required. 7. You will send confirmation of publication of advertisement either by or by fax on same day. 8. Institute may send advertisement by , by fax or by courier. 9. Advertisements shall only be published against written orders of Institute issued by Stores & Purchase Department. 10. Payment shall be normally made within 45 days after receipt of bill, provided bill is accompanied by the documents required such as DAVP rates etc. 11. If any question, difference or objection whatsoever shall arise in any way connected with or arising out of this or the meaning or operation of any part thereof or the rights, duties or liabilities of either party than same in so far as the decision of any such matter is herein before provided for and has been so decided, every such matter including whether its decision has been otherwise provided for and/or whether it has been finally decided accordingly or whether the contract should be terminated or has been rightly terminated in whole or part and as regards the rights and obligations of the parties as the result of such termination shall be decided by the Chief Coordinator- NEST, NISER, Bhubaneswar and decision shall be final and binding.
