7 AIMS & OBJECTIVES 1. The Aim and objectives of the Board are to provide basic education for primary, high school intermediate which includes 10th & 12th Class courses. The mission of the Board is to achieve all round development and growth for the masses through education UTTAR PRADESH STATE OPEN SCHOOL BOARD is an autonomous independent and non Governmental Board for the conduct of Secondary and Senior Secondary School Examination. Providing an alternative to choose form either Government aided Board or a Non-Government independent Autonomous body, The Board aims to provide education to all children, especially those in rural and remote areas, at least up to the Senior Secondary level. It is further submitted that the Board is a private for the establishment of a Non-Government Board for conducing 10th & 12th Common Examination for Students studying in school affiliated and likely that be affiliated by Utter Pradesh State Open School Board. 2. The Board trustees/members has the constitutional right under Article 19(1) (g) to pursue any profession or any occupation and running teaching institutes have been included as part of occupation as held by Hon'ble Supreme Court in T.M.A. Pai Foundation Vs State of Karnataka (sc) 2003 (2) SCT 385. The relevant portion of the above said judgment is reproduced as under : Private education is one for the most dynamic and fastest growing segments of post-secondary at the turn of the twenty first century. A combination of unprecedented demand for access to higher education and the inability or unwillingness of government to provide the necessary support has brought private higher education to the forefront. Private becoming increasingly important in parts of the world that relied almost entirely on the public sector. 3. Not only has demand overwhelming the ability of the governments to provide education, there has also been a significant change in the way that higher education is perceived. The idea of an academic degree as a "private good" that benefits the individual rather than a "public good" for society is now widely (sic). The logic of today's economics and an ideology of privatization have contributed to the resurgence of private higher education, and the establishing of private institutions where none or very few existed before. 4. The right to established and administer broadly comprises of the following rights : (a) to admit students (b) to set up a reasonable fee structure to constitute a governing body. (d) to appoint staff (leaching and non-teaching) (e) to take action it there dereliction of duty on the part of any employees. 5. The pursuit and practice of truth regardless of consequences has been the ambition of the universities. Their prayer is that of the dying Goethe: "More light" or that of Ajax in the light." The respect in which the universities of Great Britain are held is due to the freedom from governmental interference which they enjoy constitutionally and actually. Our universities should be released tram the control of polities. (4)
8 LIBERAL EDUCATION All education is expected to be liberal. it should free us from the shackles of ignorance, prejudice and unfounded belief. If we are incapable of achieving the good life, it is due to faults in our inward being, to the darkness in us. The process of education is the slow conquering of this darkness,. To lead us from darkness to light, to fee us from every kind of domination except that of reason is the aim of education." There cannot be a better exposition than what has been observed by these renowned educationist with regard to autonomy in education. The aforesaid passage clearly shows that the governmental domination of the education. The only reasonable restriction on the exercise of this right can be imposed under Article 19(1)(g) and is imposed in clause 19 (6). The only restriction is that State can make the law imposing reasonable restriction in the interest of general public or any restriction regarding profession and technical qualification necessary of practicing any profession or occupation, trade or business. Since so far no such professional or technical qualification have been notified, therefore, therefore, the trustees/members of the Board through their trust have a fundamental right to carry on the profession / occupation of running the Institutes imparts education. We want to also clarify that some states and objection has been pointed out to the name of the Board in private sector but later all such objection have been resolved after the Board pointed out that the world "Board"/Councils is not reserved by any statute that it cannot be used by any other trust. many Boards/ Councils had applied to the Registration Authority and they have approved of the name of "board" / Council. If there would have been any objection to its name or this name is not permitted by law then the Registrar would not had registered it. It is also pertinent to mention here that one of the prominent and well known Board providing Secondary and Senior Secondary Examinations for the student all over the country is the council for Indian Scollo Certificate Examinations (ICSE), which is a registered society. So is the CBSE which stands for Central Board of Secondary Education. Under Human Rights Protection Act 1993 autonomous bodies have been given special protection & consideration (For further details refer :AIR 1993 SC ) In the case of State of MP vs Nivedita Jain AIR 1981, SC held that complete relaxation of qualifying marks for SCs/STs in Pre-Medical Examinations for admission to medical college colleges is valid. The 93rd Constitution Amendment Act, termed by Minister of Human Resource Development, Arjun Sing as only a piece of "enabling legislation", may have opened Pandoras box by amending Article 15 of the constitution to provide for reservation for OBCs in all "educational Institution" including private, whether aided or unaided, excepting minority educational Institution" including private, whether aided or unaided, excepting minority educational institutions. The Indian Parliament has passed the 104th Constitution Amendment Bill, providing reservations the socially and educationally backward classes, besides the Scheduled Classes and Scheduled Tribes, In tall private aided and unaided educational institutions. 9 EXAMINATION The final examination in theory and practical are held at the end of the session in January and June in supplementary exams in July -August A candidate has declared successful on scoring minimum of 34% marks in each paper. CERTIFICATION Every successful declared student will be awarded D.M.0 I Certificate by the UTTAR PRADESH STATE OPEN SCHOOL in each education in each education. AGE & SEX There will be no restriction of age, caste, sex, region, country under open and distance education system of the board. MEDIUM The medium of each education program will be according to their Regional Language/State Language/Country Language, But Question paper will be published only in English; student can give answer in English/Hindi or his/her state language. But it should be mentioned earlier in the examination forms. RULES & REGULATIONS Check and satisfy necessary information about education program/board before admission no responsibility of the institute / board after that. Fees once paid should not be refunded or changed under any rut, Every student abides to and obtains to present rule and regulations and time. 10 GENERAL CONDITIONS (i) (ii) (iii) (iv) (v) (vi) (vii) GRADING (i) (ii) (iii) iv) The Scheme of Examinations and Pass Criteria for UPSOSB, UP Examinations conducted by the Board, shall be as laid down from time to time. Class IX & XI examination shall be conducted internally by the schools themselves. The Board will conduct the external examinations at the end of class X & XII. Class X & XII examination shall be based on the syllabus as prescribed by the Board for class X & XII from time to time. Number of papers, duration of examination and marks for each subject/paper will be as specified in the curriculum for the year. The examination would be conducted in theory as well as in practical, depending upon the nature of the subject(s) and the marks/grades allotted shall be as prescribed in the curriculum. Marks/grades shall be awarded for individual subjects and the aggregate marks shall not be given. Assessment of theory/practical papers in external subjects shall be in numerical scores. In addition to numerical scores, the Board shall indicate grades in the mark sheets issued to the candidates in case of subjects of external examinations. In case of internal assessment subjects, only grades shall be shown. Letter grades on a nine-point scale shall be used for subjects of external examinations. However, for subjects of internal examination in Class X & XII the assessment shall be made on a five point scale i.e. A, B, C, D and E. The grades shall be derived from scores in case of subjects of external examination. In case of subjects of internal assessment, they shall be awarded by the schools. The qualifying marks in each subject of external examination shall be 33% at Senior School Certificate Examination. However, at Senior School Certificate Examination, in a subject involving practical work, a candidate must obtain 33% marks in the theory and 33% marks in the practical separately in addition to 33% marks in aggregate, in order to qualify in that subject. 11 Scheme of Examination (Senior School Certificate Examination) (i) The Board shall conduct examination in all subjects except General Studies, Work Experience, Physical and Health Education, which will be assessed internally by the schools. (ii) In all subjects examined by the Board, a student will be given one paper each carrying 100 marks for 3 hours. However, in subjects requiring practical examination, there will be a theory paper and practical examinations as required in the syllabi and courses. (iii) In Work Experience, General Studies and Physical and Health Education, the Schools will maintain cumulative records of student's periodical achievements and progress during the year. These records are subject to the scrutiny of the Board as and when deemed fit. (iv) A candidate from a recognized school who has some physical deformity or is otherwise unable to take part in Work Experience and Physical and Health Education, may be granted exemption by the Chairman on the recommendation of the Head of the institution, supported by the medical certificate from a Medical Officer of the rank not below an Assistant Surgeon. (v) Private/Patrachar Vidyalaya and candidates sponsored by Adult School shall be exempted from Work Experience, General Studies and Physical and Health Education. PASS CRITERIA (For X & XII) (i) A candidate will be eligible to get the pass certificate of the Board, if he/she gets a grade higher than E in all subjects of internal assessment unless he/she is exempted. Failing this, the result of the external examination will be withheld but not for a period of more than one year. (9)
13 (ii) In order to be declared as having passed the examination, a candidate shall obtain a grade higher than E (i.e. at least 33% marks) in all the five subjects of external examination in the main or at the compartmental examinations. The pass marks in each subject of external examination shall be 33%. (iii) No overall division/distinction/aggregate shall be awarded. (iv) In respect of a candidate offering an additional subject, the following norms shall be applied :- (a) A language offered as an additional subject may replace a language in the event of a candidate failing in the same provided after replacement the candidate has English/ Hindi as one of the languages; and (b) the replacement shall satisfy the conditions as laid down in the Scheme of Studies. (v) Candidates exempted from one or more subjects of internal examination shall be eligible for appearing in external examination and result shall be declared subject to fulfilment of other conditions laid down in the Pass Criteria. (vi) In order to be declared as having passed class IX Examination a candidate shall obtain 33% in all the subjects. The pass marks in each subject of the examination shall be 33% (Rule 41.1 (vi) of examination Bye laws) ELIGIBILITY FOR COMPARTMENT (For X & XII) A Candidate failing in two of the five subjects of external examination shall be placed in compartment in those subjects provided he/she qualifies in all the subjects of internal assessment. COMPARTMENT EXAMINATION (i) (ii) (iii) (iv) A candidate placed in Compartment may reappear at Compartment Examination to be held in Next by the board The candidate will be declared 'PASS' provided he/she qualifies the compartmental subjects in which he/she had failed. A Candidate who does not appear or fails at one or all the four chances of compartment shall be treated to have failed in the examination and shall be required to reappear in all the subjects at the subsequent annual examination of the Board as per syllabus and courses laid down for the examination concerned in order to pass the examination. The candidate's practical marks/internal assessment marks obtained in the 'Main examination will be carried over till the fifth chance compartmental examination. The candidate shall have the option to appear at the practical examination in the subjects involving practical or retain their previous marks in one more annual examination after the Fifth Chance Compartment. Syllabus and Courses for the Compartmental Candidates in Examination shall be the same as applicable to the candidates of full subjects appearing at the examination. For subjects involving practical work, in case the candidate has passed in practical at the main examination he/she shall appear only in theory part and previous practical marks will be carried forward and accounted for. In case a candidate has failed in practical he / she shall have to appear in theory and practical both irrespective of the fact that he / she has already cleared the theory examination. (10)
14 Senior Secondary Level (Equivalent to 12th ) A candidate must have passed secondary from this board or from any board recognized by the UTTAR PRADESH STATE OPEN SCHOOL BOARD. There must be a gap of at least two years between the year of passing secondary examination and that of appearing in the senior secondary examination. However, this gap of two years shall be counted from the year /session of earning. compartment in secondary examination in case such candidates pass the subject(s) of compartment in the subsequent two chances. All the examinations conducted by the Board are based Under "Open & Distance Education System ". The passed out students will be awarded with the certificates & mark sheets. In the event of change of address, subject and program I the student have to pay Rs. 200/ /- and 300/- respectively extra for the purpose. After 60 days of the admission, no change in subject and program will be entertained. Students should clearly indicate mane of the center and their subjects in the application forms. Normally any change in case of center & subjects are not permissible. Examinee should be particular should be particular in selecting the examination center and subjects and mention it in the examination form clearly. The list of examination centre's are sent along with the examination form. BOARD may disallow a student to appear before a centre which is not reflected or written by the candidate in the examination form. If any student/ guardian / member /teacher/ employee of a centre or institution have any dispute/disputes with the BOARD, it will be resolved only through the arbitrator appointed by the UPSOSB. The dispute/disputes of the jurisdiction will be at Jaunpur only, In all respect English version is authenticated. Every student abides to and obtains to present rule and regulations and directions of the institute/ board and also those which are to be enforced time to time. The Board /Organization run non-formal self employment education program only and not give any guarantee for further educational use or any job. If any document found bogus the admission and result should be canceled automatically without any notice.
