2 Central State Farm Hisar General Terms and Conditions of the Contract Annexure-1 1. An earnest money as mentioned in the notice inviting tender must be submitted along with technical bid documents in the form of demand draft in the favor of, Hisar and payable at Hisar or the documents/receipt as a proof if the EMD is submitted in the mentioned account should be attached along with the technical documents. In no case Cheques or cash will be accepted. The tenders will not be accepted if the earnest money is not sent with the bid documents. 2. Only responsive bidders who fulfill the technical specifications (Annexure 1, 2 & 4 & Technical bid form), EMD condition etc. will be considered for comparison of rates etc. 3. The test certificate from the competent institute or Govt. of India Testing Institutes authorized for testing of the machines should be attached otherwise the tenders will be cancelled. The list of institutes other than Govt. testing centers authorized for issuing test certificates is attached as annexure Only PAN Card holder, GST payer agencies are eligible to fill this tender. Interested bidders shall quote their GST nos. with documentary proof in the technical bid form. 5. The rates quoted by the firm shall be valid for 30 days from the date of opening of tenders. 6. The rates should be F.O.R. Central State Farm,, Hisar including of all taxes, packing, transit and forwarding and statutory levies, if any and no extra charges will be given for these items. 7. Delivery: The supplier shall undertake to complete supply and commissioning of equipments at sites within 30 days of from the date of placing of purchase order by the consignee. 8. It is emphasized by the Corporation and understood by the supplier that the period of delivery stipulated in S.No. 8 is the essence of the contract. It is admitted by the supplier that any delay to the delivery will cause damages to the corporation. In case of any delay in delivery, the total amount of the undelivered material will be deducted from the suppliers payment at the rate of ½ % per day delay of the value of undelivered material as liquidation damage subject to maximum of 20 days, after the which the contract will be terminated. In no circumstances the material will be received after 30th Nov and in that case EMD of the party will be forfeited. 9. Delivery Inspection: The pre delivery inspection will be carried out at the works of the supplier within 30 days from the issue of supply order for inspection of the equipments to confirm their conformity of the contract. The authorized nominee of Nationals seeds Corporation Limited; Hisar may carry out the inspection at the works of the supplier as soon as the equipments are ready to be dispatched from the supplier works. No advance payment shall be given. 10. Deviation in Specification: The deviation in the technical specifications for the implements which are tested by the government institutes will only be considered if the satisfactory bids on the mentioned technical specifications are not received in tenders. The most appropriate technical specifications for the implements will only be considered for finalizing the bids by the tender committee. 11. The warranty/guarantee for a minimum time period of 12 months have to be provided by the bidder. 12. Refund of earnest money: The EMD of unsuccessful bidders will be returned to the bidders through cheques. 13. Settlements of disputes: All disputes in relation to the tender arising out of this agreement or touching the subject matter of this agreement shall be decided by the process of settlement and arbitration as per the Arbitration and Conciliation Act, The appointment of Arbitrator shall be made as per provisions of the Arbitration and Conciliation Act, 1996 with the approval of the Chairman cum Managing Director of the N.S.C.
