The following draft of notification which the Central Government proposes to issue in exercise of the powers conferred by subsection (1), clauses (v) and (xiv) of subsection (2) and subsection (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) is hereby published, as required under subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public likely to be affected thereby; and notice is hereby given that the said draft notification shall be taken into consideration on or after the expiry of a period of sixty days from the date on which copies of the Gazette of India containing this notification are made available to the Public; Any person interested in making any objections or suggestions on the proposals contained in the draft notification may forward the same in writing, for consideration of the Central Government within the specified period to the Secretary, Ministry of Environment, Forest and Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road, Aliganj, New Delhi110003, or at address: eszmef@nic.in Draft Notification Whereas, the Kaimur Wildlife Sanctuary, situated in the then Shahabad district, and presently in Rohtas and Kaimur District, lying between Latitudes 24 3 and 25 0 N and Longitude and 85 0 E, in the State of Bihar, spread over an area of sq. km was notified as wildlife sanctuary vide notification of the Government of Bihar, Forests Department number S.O dated 20th July, 1979 and under the provisions of the Wild Life (Protection) Act, 1972 (53 of 1972). And whereas, the Leopard, Hyena, Jackal, Wolf, Wild Boar, Chowsingha (four horned antelope), Sloth Bear, Black Buck, Cheetal, Sambhar, Nilgai, Jungle Fowl, Python, Mugger, Langur, Monkey and more than 100 bird species are the species of vital importance in Kaimur Wildlife Sanctuary, which includes endangered species like Leopard, Black buck, Chinkara, Four horned antelope (chausingha). And whereas, this sanctuary is rich with the following types of forests, namely: i) Northern Tropical Dry Deciduous Forests and Dry Sal Forests having common associates of Sal such as Asan, Kend, Sidha, Piar, Dhaura, Amla, Harre, Bahera, Bija, Karamand occasional Gamhar and Jamun; ii) the open and scrub forests having Ber, Kanaudaa, Capparis spp., Randiaspp., etc with very occasional stems of Kend, Sidha, Hare, and Mahua; iii) Open miscellaneous forests having Asan, Kend. Kusum, Karam, Piar, Dhaura, Bharkad, Gamhar, Ber, Salai, Amla, Hare, Bahera, DudhKoraya and occasional Mahua and Bija with Khair also being an important associate of this type of forests iv) Miscellaneous forests with Bamboo (Dendrocalamus strictus); and v) Salai forests; And whereas, the forests of this sanctuary also intercept rainfall and help recharge ground water aquifer and protect rivers and streams against siltation by minimizing soil erosion; Durgawati and Karmnasha are the main perennial rivers originating from the sanctuary; And whereas, this sanctuary is located in the eastern extremity of Vindhyan hill ranges and its plateau landforms are unique in the State of Bihar; the plateau tract in sanctuary is inhabited by Chero, Oraon and Kharwar tribes with sociological significance; And whereas, it is necessary to conserve and protect the area around the protected area of Kaimur Wildlife Sanctuary as Ecosensitive Zone from ecological and environmental point of view; Now, therefore, in exercise of the powers conferred by subsection (1) and clauses (v) and (xiv) of subsection (2) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986) read with subrule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area upto 2 kilometer from the boundary of the protected area of Kaimur Wildlife Sanctuary in the State of Bihar as the Ecosensitive Zone (hereinafter called as the Ecosensitive Zone), details of which are as under, namely: 1. Extent and boundaries of Ecosensitive Zone.(1) The Ecosensitive Zone varies from zero to two kilometers around the Kaimur Wildlife Sanctuary excluding Southeastern and Southern side of the Sanctuary and also the Western side of the Sanctuary which shares boundary with State of Uttar Pradesh. The area of the Ecosensitive Zone is square kilometers. (2) The Ecosensitive Zone is bounded by 24º " N latitude and 84º E longitude towards eastnorth (Reference Global Positioning System point No.22 of map); 24º "N latitude and 83º "E longitude towards west (Reference Global Positioning System point No.49 of map); 25º "N latitude and 83º "E

(3) A map of Ecosensitive Zone boundary together with its latitudes and longitudes of extremes and extent is appended to this notification as Annexure I. (4) A list of 246 villages falling within two kilometer of the Kaimur Wildlife Sanctuary Ecosensitive Zone alongwith their longitudes and latitudes at prominent points is appended to this notification as Annexure II. (5) The list of 56 villages falling within 0 kilometer of the Kaimur Wildlife Sanctuary alongwith their longitudes and latitudes at prominent points is appended to this notification as Annexure III. (6) The Annexure II and Annexure III shall be subject to confirmation by the State Government in the Zonal Master Plan. 2. Zonal Master Plan for the Ecosensitive Zone. (1)The State Government shall, for the purposes of effective management of the Ecosensitive Zone, prepare, in consultation with the local people and the following concerned State Departments, a Zonal Master Plan within a period of two years from the date of publication of this notification in the Official Gazette and submit the same for the consideration and approval of the Central Government in the Ministry of Environment, Forest and Climate Change, namely: (i) Forest, Environment and Wildlife Management; (ii) Bihar Police; (iii) Urban Housing Development; (iv) Tourism; (v) Rural Management and Development; (vi) Irrigation and Flood Control; (vii) Public Works Development; (viii) Land Revenue; and (ix) Disaster Management. (2) The Zonal Master Plan shall provide for restoration of degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, ground water management, soil and moisture conservation, needs of local community and such other aspects of ecology and environment that need attention. (3) The Zonal Master Plan shall demarcate all the existing and proposed urban settlements, village settlements, types and kinds of forest, agriculture areas, horticultural areas, lakes, other water bodies and entrepreneurial units. (4) The Zonal Master Plan shall contain the measures specified for regulation of activities specified in column(2)of the table under paragraph 4. (5) The Zonal Master Plan so prepared shall be coterminus with the regional development plan. 3. Measures to be taken by State Government.The State Government shall take the following measures for giving effect to the provisions of this notification, namely: (1) Land Use. such as Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational purposes in the Ecosensitive Zone shall not be used or converted into areas for commercial or industrial related development activities: Provided that the conversion of agricultural lands within the Ecosensitive Zone may be permitted on the recommendation of the State Level Ecosensitive Zone Monitoring Committee, and with the prior approval of the State Government, to meet the residential needs of the local residents, and for the activities listed at item numbers 24, 30 and 36 specified under column (2) of the table in paragraph 4, namely: (i) Small scale industries not causing pollution, (ii) Rainwater harvesting, (iii) Cottage industries including village artisans, etc.: Provided further that no use of tribal land shall be permitted for commercial or industrial related development activities without the prior approval of the State Government and without compliance of the provisions of the law for the time being in force, including the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006(2 of 2007): Provided also that any error appearing in the land records within the Ecosensitive Zone shall be corrected by the State Government, after obtaining the views of State Level Ecosensitive Zone Monitoring Committee, only once in each case and the correction of said error shall be intimated to the Central Government in the Ministry of Environment, Forests and Climate Change: Provided also that the above correction of error shall not include change of land use in any case except as provided in this subparagraph. (2) The catchment areas of all natural springs shall be identified and plans for their conservation and rejuvenation shall be incorporated in the Zonal Master Plan and strict guidelines be drawn up for the prohibition of development activities at or near these areas. (3) The activity relating to tourism within the Ecosensitive Zone which shall form part of the Zonal Master Plan shall be as under, namely: (i) all new tourism activities or expansion of existing tourism activities within the Ecosensitive Zone shall be in accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forests and Climate

18 18 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II SEC. 3(ii)] Change and the Ministry of Tourism and by the National Tiger Conservation Authority, with emphasis on ecotourism, ecoeducation and ecodevelopment and based on carrying capacity study of the Ecosensitive Zone; (ii) new construction of any kind shall not be allowed within the Ecosensitive Zone. (iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities shall be permitted by the concerned regulatory authorities based on the actual site specific scruitinisation and recommendation of the State Level Ecosensitive Zone Monitoring Committee. (4) All sites of valuable natural heritage in the Ecosensitive Zone such as the gene pool reserve areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc. shall be identified and be preserved and proper plan be drawn up for their protection and conservation, within six months from the date of publication of this notification and such plans shall form part of the Zonal Master Plan. (5) All manmade heritage sites such as Buildings, structures, artefacts, areas and precincts of historical, architectural, aesthetic, and cultural significance shall be identified in the Ecosensitive Zone and plans for their conservation shall be prepared within six months from the date of publication of this notification and incorporated in the Zonal Master Plan. (6) The Environment Department or the State Forest Department of Bihar shall draw up guidelines and regulations for the control of noise pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981). (7) The Environment Department or the State Forest Department of Bihar shall draw up guidelines and regulations for the control of air pollution in the Ecosensitive Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981). (8) The discharge of treated effluent in Ecosensitive Zone shall be in accordance with the provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974). (9) Disposal of solid wastes shall be as under: (i) The solid waste disposal in Ecosensitive Zone shall be carried out as per the provisions of the Municipal Solid Waste (Management and Handling) Rules, 2000 published by the Government of India in the Ministry of Environment and Forests vide notification number S.O. 908 (E), dated the 25th September 2000; (ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and nonbiodegradable components; (iii) the biodegradable material shall be recycled preferably through composting or vermiculture; (iv) the inorganic material shall be disposed of in an environmentally acceptable manner. (10) The biomedical waste disposal in the Ecosensitive Zone shall be carried out as per the provisions of the Bio Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in the Ministry of Environment and Forests vide Notification number S.O. 630(E), dated the 20th July, (11) The vehicular movement of traffic shall be regulated in a habitat friendly manner and specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal master plan is prepared and approved by the Ministry of Environment, Forests and Climate Change, State Level Ecosensitive Zone Monitoring Committee shall monitor compliance of vehicular movement as per the rules and regulations in force. 4. List of activities prohibited or to be regulated within the Ecosensitive Zone. All activities in the Ecosensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986) and be regulated in the manner specified in the Table below, namely: Table Sl. Activity Remarks No. (1) (2) (3) A. Prohibited Activities: 1. Commercial Mining, stone quarrying, (a) All new and existing mining (minor and major minerals), crushing units and brick kiln. stone quarrying and crushing units are prohibited except for the domestic needs of bona fide local residents. (b) The mining operations shall strictly be in accordance to the orders of the Hon ble Supreme Court dated 4 th August, 2006 in the matter of T.N. Godavarman Thirumulpad Vs. Union of India in W.P.(C) No.202 of 1995 and order dated 21 st April, 2014 in the matter of Goa Foundation Vs. Union of India in W.P.(C) No.435 of Setting up of saw mills. 3. Setting up of industries causing water or air No new or expansion of existing polluting industries shall be or soil or noise pollution. 4. Use or production of any hazardous substances permitted within the Ecosensitive Zone.

No new or expansion of existing commercial establishments such as hotels and resorts shall be permitted within the Ecosensitive Zone. 6. Commercial use of firewood. 7. Establishment of new major hydroelectric projects. 8. Undertaking activities related to tourism like overflying the sanctuary area by hotair balloons, etc. 9. Use of plastic carry bags. 10. Discharge of untreated effluents and solid waste in natural water bodies or land area. 11. Construction activities. No new construction of any kind shall be allowed within the Ecosensitive Zone, except for the domestic needs of local residents including the activities listed at item numbers 30 and 36. In the case of activities listed at item number 24, the construction activity shall be regulated and kept at the minimum. B. Regulated Activities: 12. Felling of trees. (a) There shall be no felling of trees on the forest land or Government or revenue or private lands without prior permission of the competent authority in the State Government. (b) The felling of trees shall be regulated in accordance with the provisions of the concerned Central or State Act and the rules made thereunder. 13. Drastic change of agriculture system 14. Commercial water resources including ground water harvesting. 15. Erection of electrical cables Promote underground cabling. 16. Fencing of existing premises of hotels and lodges. (a)the extraction of surface water and ground water shall be allowed only for bona fide agricultural use and domestic consumption of the occupier of the land. (b) The extraction of surface water and ground water for industrial or commercial use including the amount that can be extracted, shall require prior written permission from the concerned Regulatory Authority. (c) No sale of surface water or ground water shall be permitted. (d) Steps shall be taken to prevent contamination or pollution of water from any source including agriculture. 17. Widening and strengthening of existing roads and construction of new roads 18. Movement of vehicular traffic at night For commercial purpose. 19. Introduction of exotic species. 20. Protection of hill slopes and river banks. 21. Commercial Sign boards and hoardings. 22. Construction of telecommunication (Cellular phone) towers 23. Discharge of treated effluents in natural water bodies or land area. Shall be done with proper Environment Impact Assessment and mitigation measures, as applicable Recycling of treated effluent shall be encouraged and for disposal of sludge or solid wastes, the existing regulations shall be followed. 24. Small scale industries not causing pollution. Nonpolluting, nonhazardous, smallscale and service industry, agriculture, floriculture, horticulture or agrobased industry producing products from indigenous goods from the Ecosensitive Zone which do not cause any adverse impact on environment. 25. Collection of Forest produce or NonTimber Forest Produce (NTFP). 26. Security Forces Camp

New wood based industry C. Permitted Activities: 29. Ongoing agriculture and horticulture practices by local communities along with dairies, dairy farming and fisheries. 30. Rain water harvesting. Shall be actively promoted. 31. Organic farming. Shall be actively promoted. 32. Adoption of green technology for all activities. Shall be actively promoted. 33. Drastic change of agriculture system 34. Use of renewable energy sources 35. Vegetative fencing 36. Cottage industries including village artisans, etc. 5. Ecosensitive Zone Monitoring Committee. (1) The Central Government shall for effective monitoring of the Ecosensitive Zone, constitute a Committee of the State level to be called the State level Ecosensitive Zone Monitoring Committee (hereinafter referred to as SESZMC), comprising of: (i) The Conservator of Forest of the Kaimur Wildlife Sanctuary, Government of Bihar Chairman; (ii) Representative of the Patna Revenue Division, Patna Member; (iii) Representative of the Department of Mines & Geology, Government of Bihar Member; (iv) Representative of the District Soil Conservation Officer, Rohtas/Kaimur Member; (v) One representatives of NonGovernmental Organizations working in the field of environment (including heritage conservation) to be nominated by the Government of Bihar Member; (vi) The Regional Officer, Bihar State Pollution Control Board, Patna Member; (vii) Representative of Districts Rohtas/Kaimur Agriculture Department, Government of Bihar Member; (viii) Representative of Districts Rohtas/Kaimur Urban Development and Housing Department, Government of Bihar Member; (ix) Districts Collector of Rohtas/KaimurMember; (x) Divisional Forest Officer (Incharge of Protected Area) Member Secretary; (2) The State level Ecosensitive Zone Monitoring Committee shall monitor the compliance of the provisions of this notification. (3) The activities that are covered in the Schedule to the notification of the Government of India in the Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006, and are falling in the Ecosensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinized by the State level Ecosensitive Zone Monitoring Committee based on the actual sitespecific conditions and referred to the Central Government in the Ministry of Environment, Forests and Climate Change for prior environmental clearances under the provisions of the said notification. (4) The activities that are not covered in the Schedule to the notification of the Government of India in the Ministry of Environment and Forests number S.O. 1533(E), dated the 14th September, 2006 but are falling in the Ecosensitive Zone, except the prohibited activities as specified in column(3) of the Table under paragraph 4 thereof, shall be scrutinised by the State level Ecosensitive Zone Monitoring Committee based on the actual sitespecific conditions and referred to the concerned Regulatory Authorities. (5) The Member Secretary of the State level Ecosensitive Zone Monitoring Committee or the concerned Collector or the concerned park incharge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 against any person who contravenes the provisions of this notification. (6) The SESZMC may invite representatives or experts from concerned Departments, representatives from Industry Associations or concerned stakeholders to assist in its deliberations depending on the requirements on issue to issue basis. (7) The SESZMC shall submit the annual action taken report of its activities as on 31st March of every year by 30th June of that year to the Central Government in the Ministry of Environment and Forests and Climate Change as per pro forma given in Annexure IV. (8) The Central Government in the Ministry of Environment, Forests and Climate Change may give such directions, as it deems fit, to the State level Ecosensitive Zone Monitoring Committee for effective discharge of its functions. 6. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon ble Supreme Court of India or the High Court or National Green Tribunal.
